In re The last will and testament of Michael Kennedy Fisherman of the Bay of Islands in the Island of Newfoundland. I Michael Kennedy considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last will and testament in manner and form following (that is to say) First I give and bequeath unto my beloved wife Bridget Kennedy to have and to hold during the term of her natural life, all that messuage or portion of land consisting of two farms situate, lying and being in Birchy Cove on the South West Bank of the Humber Sound of the Bay of Islands aforementioned, one of which is bounded and described as follows (that is to say) on the east by land owned by John Cunning and on the west by land owned by Samuel Ballam, the other of which is bounded on the east by a running brook and on the west by land owned by the Church of England, together with waterside privaledges wharves, store, dwelling house and all buildings of whatever description thereon erected or to be erected, with all my personal possessions of what description soever. Also I give and bequeath to my said beloved wife Bridget Kennedy to have and to hold during the term of her natural life, that fishing station owned by me and being lying and situate in Henley Harbor, Labrador, with land dwelling house, store, stage, wharf, nets, boats and all and every the appertubances thereunto belonging- And from and after the death of my said wife I give and bequeath the said messuages or tenements lands and hereditaments unto my two well beloved daughters Mary Josephine and Elizabeth Ann as tenants in common and to their heirs and assigns for ever. And I hereby give and bequeath to my son Michael the sum of one shilling of the lawful money of Great Britain and Ireland And lastly as to all the rest residue and remainder of my personal estate goods and chattels of what kind and nature soever, I give and bequeath the same to my said beloved wife Bridget Kennedy whom I hereby appoint sole executrix of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this second day of April in the year of Our Lord one thousand eight hundred and seventyeight. Michael his X mark Kennedy. The above instrument consisting of one sheet was now here subscribed by Michael Kennedy the testator in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses, Maurice Bolan, Thomas Lewis, Thomas F. Vavassour.
