Will of Richard Hatt Noble

IN RE:   RICHARD HATT NOBLE.    DECEASED

This is the last will and Testament of me Richard Hatt Noble of the Hill Caversham in the county of Oxford Esquire I revoke all former wills made by me I appoint my nephew George Acheson Warre and my nieces Emma Noble Noble Emily Agnes Warre and Agnes Jane Graham Executor and Executrixes and Trustees of this my will
I bequeath the following legacies that is to say

  • To my niece Christina Graham Graham widow ten thousand pounds
  • To my said niece Emma Noble Noble fourteen thousand pounds
  • To my niece Caroline Noble Noble the wife of the Reverend John Padmore Noble four thousand pounds
  • To my nice Lady Eleanor Noble Elles widow six thousand pounds
  • To my niece Agnes Graham Lyon Campbell widow ten thousand pounds
  • To my said nice Emily Agnes Warre eight thousand pounds
  • and to my said nephew George Acheson Warre two thousand pounds all the said legacies to be free of legacy duty.
I also bequeath the following legacies that is to say To my said niece Emma Noble Noble the legacy or sum of three thousand five hundred pounds free of legacy duty in addition to the aforesaid legacy of fourteen thousand pounds And to my said niece the said Emma Noble Noble in addition to the aforesaid legacies of fourteen thousand pounds and three thousand five hundred pounds the legacy or sum of two thousand pounds
And to my said niece Emily Agnes Warre in addition to the aforesaid legacy of eight thousand pounds bequeathed to her the legacy or sum of two thousand pounds such two several legacies or sums of two thousand pounds and two thousand pounds to be free of legacy duty and to be paid within one calendar month after my decease and to be used by them towards housekeeping expenses and their immediate necessities
And I also give and bequeath to my said niece Emma Noble Noble all my plate linen china glass books pictures prints wines liquors furniture and other household effects and all my carriages horses live stock farm implements hay straw fodder and all other goods chattels and effects in or upon my stable outbuildings garden farm and land occupied by me at the time of my decease absolutely and free of legacy duty

And as to all the rest residue and remainder of my estate both real and personal I direct that after the same shall have been ascertained and realized by my said executors and trustees the same shall be equally divided between my said nieces Christina Graham Graham Emma Noble Noble Caroline Noble Noble Eleanor Noble Ellis Agnes Graham Lyon Campbell and Emily Agnes Warre for their own use and benefit

I declare that my executors and trustees may permit my real and personal estate to remain invested in such securities as they may be at the time of my decease and may postpone the sale and conversion thereof or any part thereof for as long as they shall think fit and that the rents profits and income to accrue from and after my decease of and from such part of my estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the proceeds of such sale and conversion would be payable or applicable under this my will as if such sale and conversion had been actually made
Aand I also declare that should any or either of my said nieces or my said nephew die in my lifetime the legacy or legacies hereby bequeathed to them her or him shall fall into and form part of my residuary estate And I also declare that each or any of my trustees may at any time with the consent of his or her co-trustee or co-trustees (if any) resign the trusteeship of this my will And I also declare that if and whenever any trustee for the time being of this my will shall die or resign the trusteeship or refuse or become incapable to act as a trustee then and in every such case it shall be lawful for the surviving or continuing Trustees or Trustee for the time being of this my will (and for this purpose every resigning or refusing trustee if willing to act in the execution of this power shall be considered a continuing trustee) or for the executors or administrators of the last acting or surviving trustee to appoint a new trustee or new trustees in the place of the trustee or trustees so dying or resigning or refusing or becoming incapable to act as aforesaid and upon every such appointment the number of Trustees may be altered provided they be not reduced below two
And I declare that all trusts and powers hereby reposed and vested in my Trustees may be exercised by the survivors or survivor of them or other the persons or person who shall for the time being be the trustees or trustee of this my will And I also declare that each and every executor and trustee of this my will shall be answerable for his or her own acts and defaults only and not for those of any co executor or co trustee or of any agent or manager appointed by him her or them nor for any banker broker or other persona with whom monies or securities may be deposited nor for any other loss unless the same shall be caused by his or her own wilful act or default and the trustees may reimburse themselves out of the trust premises all costs and expenses incurred by them in or about the execution of the trusts of this my will or in relation thereto

In witness whereof I have hereunto set my hand this ninth day of December one thousand nine hundred and three - Richd Hatt Noble - Signed and declared by the said Testator Richard Hatt Noble as and for his last will and Testament in the presence of us both present at the same time who in his presence at his request and in the presence of each other have hereunto set our names as witnesses

This is a Codicil to the last will and Testament of me Richard Hatt Noble of The Hill Caversham in the county of Oxford Esquire which will bears date the ninth day of December one thousand nine hundred and three whereas I have by my said will bequeathed to my niece Emma Noble Noble (inter abia) a legacy or sum of three thousand five hundred pounds free of legacy duty now I hereby revoke the said legacy of three thousand five hundred pounds and give and bequeath to her in lieu thereof the legacy or sum of eight thousand five hundred pounds free of legacy duty And I direct that my executors and trustees shall pay and satisfy the specific pecuniary legacies bequeathed by my said will to my nephew and nieces therein named before paying the said legacy or sum or eight thousand five hundred pounds hereby bequeathed to my said niece Emma Noble Noble

And whereas I have by my said will directed that should my said nephew or either of my said nieces die in my lifetime the legacy or legacies thereby bequeathed to him her or them should fall into and form part of my residuary estate now I hereby declare that should my said nephew or either of my said nieces die in my lifetime leaving a child or children who shall survive me and being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry under that age then and in every such case such child or children shall take (and if more than one equally between them) the legacy or sum which his her or their parent would have taken if such parent had survived me and in all other respects I confirm my said will In witness whereof I have hereunto set my hand this twenty first day of December one thousand nine hundred and three Richd Hatt Noble - Signed and declared by the said Testator Richard Hatt Noble as and for a Codicil to his last will and Testament in the presence of us both present at the same time who in his presence at his request and in the presence of each other have hereunto signed our names as witnesses -
