Will of Michael Mitchell

IN RE:   MICHAEL MITCHELL.    DECEASED

Sheet No. 1 of the last Will and Testament of Michael Mitchell, dated this 1st day of September, 1919.

KNOW ALL MEN BY THESE PRESENTS, That I, Michael Mitchell, residing at the County of Cook in the state of Illinois, being of sound mind and disposing memory, but mindful of the uncertainty of human life, do hereby make, publish and declare this as and for my last Will and Testament in the manner and form following, that is to say:

Item I. I direct that all my just debts, expenses of my last sickness and funeral be paid out of my personal property.

Item 2. All of the rest, residue and remainder of my estate of whatsoever name or kind, and wheresoever the same may be situate, I give, devise and bequeath to my beloved wife, Mary Mitchell, and to her heirs and assigns, forever.

Item 3. I hereby appoint my son, J. T. Mitchell, to be the sole executor of this will, and direct that he be not required by any Court to furnish bonds for the faithful discharge of the duties of such office. I further authorize and empower my said executor to sell and dispose of any of my property, real or personal, upon such terms as he may see fit, at such price as he may judge most beneficial to my estate, and this without the order of any court, and I direct that in so doing he be not required to furnish additional bonds.

Item 4. This will is made and executed by me within the state of South dakota and conformably to the laws of that state, and I direct that this instrument be construed according to the laws of that state.

We, Ruby McDearmon and F. E. Snider, whose names are hereto subscribed, do hereby certify that the foregoing instrument, consisting of two sheets, each of which has been subscribed by the testator, Michael Mitchell, and by ourselves was executed by the said testator, Michael Mitchell. Sheet No. 2 of the last Will and Testament of Michael Mitchell, dated this 1st day of September, 1919.

on the day which it bears date, in our presence and in the presence of each of us; that at the time of the execution of the instrument the said testator declared in our presence and hearing, and in the presence and hearing of each of us, that the said instrument is his last Will and Testament, and we at his request and in his presence and in the presence of each other, have hereunto subscribed our names as witnesses thereto.
