Will of Mary Sidney Carter

In re: MARY SIDNEY CARTER DECEASED

I, Mary Sidney Carter, of the Borough of Brooklyn, County of Kings, City and State of New York, in the United States of America, do hereby make, publish and declare this as my last Will and Testament, in manner following:

FIRST: I order and direct that all my just debts, funeral expenses, and expenses of administration, be paid with all convenient speed.

SECOND: I give and bequeath to my niece Ethel Livingstone Carter the sum of Five hundred dollars (500) and all my wearing apparel and jewellery, including my gold and stone seal of the Carter Family;

THIRD: I give, devise and bequeath to my brothers Peter Samuel Carter and William Henry Carter, equally, should they both survive me, all my real property, together with all personal property thereon or used in connection therewith or appurtenant thereto, situated in Newfoundland, North America, which I may die seized or possessed of or entitled to, to and for their own individual use forever; and in case my said brother William Henry Carter should not survive me, I give, devise and bequeath to my said brother Peter Samuel Carter all of said property to and for his own use forever; and in case my said brother Peter Samuel Carter should not survive me, I give, devise and bequeath to my said niece Ethel Livingstone Carter his said equal share or interest in said property, to and for her own use forever; and in case both my said brothers should not survive me, I give, devise and bequeath to my said niece all of said property to and for her own use forever.

FOURTH: I give, devise and bequeath all the rest, residue and remainder of my property, both real and personal, of every description, and wheresoever situated, which I may die seized or possessed of or entitled to, to my said brother, William Henry Carter, to and for his own use forever, should he survive me; and in case he should not survive me, I give, devise and bequeath to my said brother, Peter Samuel Carter, all of said property to and for his own use forever, should he survive me; and in case he should not survive me, I give, devise and bequeath to my said niece all of said property to and for her own use forever.

FIFTH: I constitute and appoint my said brother, William Henry Carter, sole Executor of this my Will, should he be living at my death, and if he is not then living, I constitute and appoint my said brother, Peter Samuel Carter, sole Executor of this my will, should he be living at my death and if he is not then living, I constitute and appoint my said niece, Ethel Livingstone Carter, sole Executrix of this my Will, freeing and releasing my said Executor of Executrix from giving any bond or undertaking for the faithful performance of his or her duties as such Executor or Executrix. In Witness Whereof, I have hereunto set my hand and seal this 2nd day of May 1916. MARY SIDNEY CARTER (L.S.)

The foregoing instrument, consisting of two typewritten pages, including this page, was on the day and date thereof, at the County and State of New York, in the United States of America, Signed, Sealed, Published and declared by the above named Testatrix as and for her last Will and Testament, in our presence, who, at her request and in her presence, and in the presence of each of us, have subscribed our names as witnesses hereto.
