Will of James D. Gill from Newfoundland will books volume 4 pages 30-31 probate year 1879

 

In re
         James D. Gill deceased.

In the name of God Amen. I James D. Gill of Brooklyn Kings County and State of New York being of sound mind & memory but in ill health do make this my last will and testament.

First, I will and direct all my just debts to be paid.

Secondly, I give devise and bequeath to my children Theodore N., Adelaide E., Albert J., Anselle V.W., Edward J., Caroline E. and Herbert, all my real and personal estate, whatsoever and wheresoever situated, to have and to hold the same to them their respective heirs and assigns for ever, share and share alike.

Thirdly, If any one of them die before attaining the age of twenty one years, without lawful issue, the share of the one or any of them so dying without lawful issue, before attaining the age of twenty one years, to go to the survivors share and share alike. If any one or more of them die before attaining the age of twenty one years leaving lawful issue, such issue to take the share of his, her or their parent share and share alike.

Fourthly, I authorize and empower my executor hereinafter named, to sell at private or public sale, all of my real and personal estate at any time for the best price he can obtain for the same in his judgment and discretion, and direct him to account to the above named children or their guardians for the proceeds according to the provision of this will.

Fifthly, I will and direct that those of my children who are infants, and until They respectively come of age, shall have the use of their respective shares of my estate for their respective maintenance, education and support, and direct that my executor or their respective guardians faithfully see to the execution of this provision of my will, meaning hereby that the executor only act as executor, and that if facts and circumstances require guardians shall take all the charge of the respective interests of said infant children.

Sixthly I hereby constitute and appoint my son Theodore N. Gill my sole executor of this my last will and testament hereby revoking all other wills by me made. In witness whereof I have hereunto set my hand and seal this twenty eight day of January one thousand eight hundred and sixty four James D. Gill LS Signed sealed witnessed and declared by the said testator to be his last will and testament in our presence who at his request have signed the same as witnesses and who in his presence and in the presence of each other have signed the same as witnesses, Hetty Vosburgh, 415 4 Avenue New York.
