Will of Henry Stokes Hutchings

In re: HENRY STOKES HUTCHINGS DECEASED.

I, Henry Stokes Hutchings of 169 Gleneldon Road Streatham in the County of London Retired Lieutenant of the Royal Navy hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last will I appoint my wife Alice Ellen Hutchings to be the sole Executrix and Trustee of this my will I bequeath to my said wife absolutely all the plate linen china glass books pictures prints furniture jewellery and articles of household use or ornament consumables stores and other articles and effects of every kind which at my death shall be in or about my dwelling house but except money or securities for money AND I also bequeath to her the sum of fifty pounds to be paid to her immediately after my death AND I bequeath to my old servant Rebecca Williams the sum of ten pounds free of duty I devise and bequeath all the real and personal estate not hereby or by any codicil otherwise specifically disposed of and which I can dispose of by will in any manner I think proper either as beneficially entitled thereto or under any general power unto the Trustee hereinbefore named Upon trust that the Trustee shall sell the said real estate (including chattels real) and call in sell and convert into money such part of my personal estate as does not consist of money with power to postpone such sale and conversion for such a period as the Trustee may think proper AND I direct that the income of my real and personal estate however invested shall from my death be treated and applied as income and no part thereof is to be added to capital except accumulations of surplus income (if any) during a minority

And I direct that the Trustee shall out of the monies to arise from the sale and conversion of my said real and personal estate and out of my ready money pay my funeral and testamentary expenses and debts and the legacies hereby or by any codicil hereto bequeathed I direct that the Trustee shall invest the residue of the said moneys in her name in manner following and not otherwise that is to say in any investments which by or pursuant to any Public General Act of Parliament for the time being in force are authorised as investments for trust money and with power for the Trustee at discretion to change such investments for others of a like nature And I declare that the trustee shall stand possessed of the investments hereinbefore directed to be made or authorised to be retained (hereinafter called the trust fund) and of the annual income thereof upon the trusts following that is to say Upon trust to retain the said income during her (my said wife's) life without power of anticipation during any coverture And after her death then I direct that the capital and income of the trust fund shall be held in trust for such of my two children Leonard Hollingworth Hutchings and Dorothy Rosa Hutchings as shall survive my said wife and if more than one in equal shares But if neither of my said children shall survive my said wife then the trust fund shall on the decease of my said wife be divided equally between if more than one the sisters of my said wife living at my decease or if but one the whole to that one IN WITNESS whereof I have hereunto set my hand to this my will the twenty first day of June One thousand nine hundred and two.
