Will of Elvira Carey

In re: ELVIRA CAREY DECEASED.

In the name of God Amen. This is the last will and testament of me Elvira Phipps of the Island of Guernsey widow of James Carey late of the said Island Esquire deceased I hereby give and bequeath the whole of the personal estate of what kind or sort soever which shall belong to me or to which I shall be entitled at the time of my decease after payment of my debts funeral and testamentary charges and after setting aside for my son Robert one seventh part or share of my household furniture to which my said son would by the laws of Guernsey have been entitled had I died intestate unto and amongst my four children by a former marriage viz, Sarah, Robert, Elvira and Julia Hutchings in equal proportions the issue of any of my said children who may have predeceased me to take and if more than one in equal portions the share to which his her or their parent would if living have been entitled And I do hereby will and order that the share of my personal estate to which my daughter Julia wife of Colonel Pott 3rd Bengal Native Infantry shall so become entitled at the time of my decease, shall constitute her separate property independently of her said husband And I direct my executor hereinafter named to have my said daughter’s share of my property placed in trust for her sole and absolute benefit so far as the laws of the place where I shall be domiciled at the time of my decease will allow thereof And I hereby nominate and appoint my said son Robert Hutchings to be the executor of this my will, hereby revoking all former and other wills by me at any time heretofore made and declaring this only to be my last will and testament of personalty In witness whereof I the said Elvira Phipps have to his my will set my hand this fourteenth day of November in the year of our Lord one thousand eight hundred and sixty six,

Signed published and declared by the said testatrix Elvira Phipps as and for her last will and testament in the presence of us, we being both present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses,

Codicil 7th October 1872. My beloved daughter Julia wife of Col. George Pott having died on the 8th of January I desire that their son Constantine Robert Pott shall receive the share of my property that I bequeathed to his mother- I have also to request that all my trinkets, boxes, books and any personal things belonging to me may be equally shared by all my beloved children Sarah, Elvira, Robert, Gaspard, Emma, Louisa, Constantine
