Will of James Wiseman from Newfoundland will books volume 4 pages 391-392 probate year 1885

In re
James Wiseman deceased.

In the name of God Amen.     This is the last will and testament of me James Wiseman son of John and Lucy Wiseman of Upper Kingstown in the Parish of Ringwood Hamts or Hamshire England late of Hearts Delight Trinity Bay, Newfoundland, Planter, being of a sound and disposing mind, and memory and understanding, First I desire to be supported by my eldest son James Wiseman as long has I may live and to be decently buried.     I gave devise and bequeath unto my eldest son James Wiseman of Hearts Delight Planter my dwelling house stores stage fish Fleak and the land attached to it for ever- On the following conditions that the said land, house or houses, store or stores is never to be sold or mortgaged for ever, that the said James Wiseman do allow my son William Wiseman to have use of the stores, stage and the Fish Flake if he require it and the said William Wiseman is to help his brother James to keep the stores, stage & Flake in good repair, otherwise the said William Wiseman forfeit his claim during his life, but that do not do away with the said W. Wiseman heir or assigns after his decease I have advise and bequeath unto my eldest son James Wiseman aforesaid my land South Side of the Pond situate Hearts Delight now used as Potatoe gardens and meadows on the following conditions that is to say that William Wiseman is to have a third part of the land as potatoes or grass ground on the South Side of the Pond situate at Hearts Delight and that he must help his brother to keep up the fence and that the land is never to be divided Also I advise and bequeath to my son William house or houses and land between William Hiscocks and Aaron Bright land never to be sold or mortgaged for ever-     Any one enquire my claim on the said land I have it my grant from His Excellency the Governor Anthony Musgrave Esqr Bearing date 10 October 1866 Registered Volume 12th No.75.     James Wiseman (LS)     Signed seald published and declared by the said testator James Wiseman as and his last will and testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names thereto, Witness Samuel Humphries,     Solomon X his mark Bright.     Edmund X his mark Ellis. In the year of our Lord November 26th A.D. 1869.
