Will of Elizabeth Sarah Diamond

In re: ELIZABETH SARAH DIAMOND. DECEASED.

I Elizabeth Sarah Diamond of Catalina in the district of Trinity Nfld widow of the late Caleb Diamond, being of sound mind and memory do hereby make and publish this as my last Will and Testament hereby revoking all former wills and testaments heretofore at any time by me made.

1st I give and devise to my daughter Margaret Mary, wife of William Wesley Halfyard the piece of land situated near the house and bounded on the North and East by the property owned by John House of William. On the West by the Public Lane, on the South by my dwelling house. Front Garden, Store house. Stable and rear garden, known as my Cabbage garden, subject to the following conditions
1st - That the said land must not in any event be sold or disposed off, in any manner to any other person or persons other than to my daughter Gertrude provided she at that time remains in possession of the adjoining land
2nd - That in the event of my daughter Margaret Mary dying without issue, the aforesaid land shall then become the property of my daughter Gertrude, her heirs, Executors, Assigns for ever. I also give and bequeath to her the sum of Two hundred dollars (cash)

2nd I give devise and bequeath to my daughter Gertrude Diamond all the rest and residue of my real and personal property The well and cellar situated on the land aforesaid devised to my daughter Margaret Mary, is to be used by the aforesaid Margaret and Gertrude jointly. But in the event of the adjoining property passing out of the hands of the said Gertrude or her heirs, the well and cellar will then become the sole property of the aforesaid Margaret or her heirs. I do hereby constitute and appoint my son in law William Wesley Halfyard and my daughter Gertrude as my Executor and Executrix respectively and jointly to carry out the provision of this my last Will and Testament. In witness whereof I have hereto set my hand at Catalina aforesaid this Nineteenth day of May One thousand nine hundred and fifteen ELIZABETH S DIAMOND.

Signed by the said Elizabeth Sarah Diamond the testatrix, in the presence of us, who in her presence and in the presence of each other at the same time subscribe our names as witnesses. RICHARD ALBERT LODGE BENJAMIN PERRY.
