1791 – 1800 Voyages, to and from Newfoundland

Extracted from Lloyd's Lists, London (Incomplete)
(While a fair sampling is extracted here; this listing is not a "complete" record listing, of Newfoundland Lloyd’s Lists voyage entries.) Vessels could be constructed cheaper in Colonial America, where virgin timber was limitless, than could be done back home in England. (Note: This listing may contain contractions, spelling and/or transcription errors, as sometimes extracted from typed material. Correction or improvement is possible in certain cases.) Voyages in which Newfoundland may have been an interim port, and for which Newfoundland was not a specifically named port within the lists, are not included here, except as examples, notes, endnotes, or other, which are asterisked as *****.

Transcribed and contributed by David Anstey. (Note: This listing may contain contractions, spelling and/or transcription errors. Correction or improvement is possible in certain cases). While I have endeavored to be as correct as humanly possible, there may be errors.

This brief list, does not include "many" of the vessels, both Naval and Merchantmen; who suffered a similar fate, as the "Harmony".

The # of vessels privateered in this era; is eye opening, but the listings remove any doubt. Routinely detailing the loss of Vessels, Crew, Guns, and Cargo. Particularly, the number and duration of engagements between opposing Naval vessels, resulted in a major loss of human life. The Sep 3, 1799 listing, shows where the English took some 900 plus Guns ( Cannons, Swivels, etc. ), from Men of War, Frigates, Indiamen, Transports, etc., in one locality only. A very substantial value. Governments of the era, routinely gave Letters of Marque, licensed Privateers, and had their vessels take Prizes. Such routine, systematic, repeated conflict at Sea, between vessels of different sovereign nations, is difficult to consider, in 2015. This cyclic conflict, in an era, where the value of a human life, was considered less. An era in which many Newfoundland merchantmen, were taken.

Pages 19 & 20. Tho' our {inhabitant} Fishers seldom fish on the Banks, but off the Harbours in Sloops...

...the 20th of August, some Years ago, used to be the last Day of the Season, and kept as a Holiday; but lately the Fishers stay longer. And whereas before used to sail for Portugal and the Straights in September, they now seldom sail till October. They fish always in the Day-time, the Cod not biting by Night. Train Oil is drawn off the Livers of the Fish, which are thrown up in Heaps when the Cod is cured; and from thence is drawn all the Oil, which comes from Newfoundland.

*Three grades of culled Codfish in early Newfoundland were Merchantable, Madeira, & West Indian. Merchantable was marketed at Roman Catholic, Mediterranean countries. Madeira was marketed at Halifax, and in the United States. Inferior or refuse, was marketed in the West Indies.

In 1615 a Quintal of fish fetched 8 Shillings. 20 Shillings during the Civil War disruption, and 12 or 13 Shillings between the Restoration and 1700.

In 1719, 20 Shillings per Quintal.

In 1615 the Newfoundland fish catch was worth 120,000 Lbs. In 1699 almost 180,000 Lbs, which was almost 3 times the value of the New England Fishery

at this time, and exceeded the value of London's tobacco imports in 1700.

Moreover, the official policy, which was still directed towards preventing colonization of the country, was calculated to discourage religious organization lest this should become a factor in influencing people to stay in the country. Even as late as the latter part of the eighteenth century Governor Milbanke refused the request of the Catholics for permission to erect a few chapels, on the ground that it was not in the interest of Great Britain "to encourage people to winter in Newfoundland"; and building chapels, with resident priests, offered such ready access to absolution that the poorer Irish, who ought to return home at the close of the season, would thus be encouraged to remain. Some religious intolerance there was, no doubt, in this refusal. It also reflected that unequivocal determination to retard colonization, that short-sighted policy whose "baneful influence", as Bishop Howley puts it, "clung like a leaden clog around the neck of the young colony, strangling all its rising aspirations", and whose harmful effects the country has not even yet outlived.

*The Rule of the Admirals: Law, Custom, and Naval Government in Newfoundland ... By Jerry Bannister page 175.

The tenor of English and British laws respecting the settling of Newfoundland, was to restrain subjects of Great Britain from colonizing the Island.

King William's Act provided only for "temporary property" in Newfoundland.

...in 1699, the Newfoundland Act permitted settlers and "byeboat keepers", to legally participate in the fishery.

*The Act for the Relief of the Poor was passed in 1601, whereby, English parish responsibility for pauper care began. Overseers were unpaid and elected annually. The Poor Rate originally = income tax. Evolved into a compulsory property tax or "rate" based on real estate value. Occupiers/tenants, paid the rate, as opposed to owners. Land and buildings were rated, but not movable wealth. One could check poor rate assessments, to find info on properties leased or owned. Value, etc.

*In England, parish officers, Churchwardens; apprenticed pauper folk to Newfoundland. As well, English parish officers may have given "consideration money" to voluntary apprentices. In Newfoundland, officers called Justices of the Peace, indentured servants to the fishery. ...the designation “indentured servant” signifies that the individual immigrated... These two key positions of English hierarchy, apprenticed folk to the early Newfoundland fishery workstation. Jacob Taverner, Lawrence Coughlan, Moses Cheater, Robert Forsyth, and John Payton, were such governmental employees, on the Newfoundland fishery workstation.

*Early English probate practice, versus early Newfoundland.

Dower Rights: The right of the widow to a specified portion of the testator's estate, during her lifetime or until her re-marriage. Usually 1/3 portion.

Dowry rights were discontinued in 1833.

Tutor: Someone appointed to be a guardian for a very young child (under 12 or 14).

Dieter - a servant who resided in Newfoundland, without any written contract, to serve under a master.

The name of the eldest son who received his inheritance according to law, may not be included in English Probate records.

*Example: May 12, 1712, Will of Edmund Moors of Christchurch. His son Edmund Moors not named. Grandson John Moors emigrated to Twillingate.

*Milton, Hampshire Parish Register: Apr 13, 1732 John, son of Edmund & Ann Moors born. Extra Parochial.

The names of others, who had previously received their inheritance; or any deceased family members, may not be included in English Probate records.

*Consider Elizabeth Tilsed, wife of John Young, at early Twillingate.

When a property owner died without leaving a valid will, the next-of-kin or creditors, may have received Letters of Administration.

*Consider: James Rousell of Parkstone, Dorset; vs. George Rousell Sr., of Notre Dame Bay.

1755. "In Newfoundland there are no land estates; but many of their salmon streams or falls, belong to patentees."

A Will may not have been Proved, to avoid the costs. Until someone made conflicting claim on property. A time lapse from creating, to Probate, of the Will.

Guardianship. Until 1660, a landholder's heirs if under age, became a ward of the crown. Crown jurisdiction was determined by an "inquisition post mortem."

"At death of a spouse, church courts and the lawyers who practiced in them regulated the disposal of assets and minors in the probate process."

When a father or widow died leaving minor children, relatives usually took the children without court sanction.

Sometimes the court appointed a guardian or curator to look after the children’s interests until they were 21.

If a child was under marriageable age (12 for girls and 14 for boys), guardianship was called "tuition."

If the child was of marriageable age but under 21, it was called "curation."

*Consider the situation of Edmund and Elizabeth Moors of Christchurch, Hampshire. Their Children, including son Edmund Moors.

Prior to 1858, the Church of England probated the estates of deceased persons.

Peculiar Courts vs Manorial Courts. The initial lower jurisdictional court of interest. Archdeaconry Courts, covering divisions of a Diocese.

Bishop's Courts. Also called Episcopal, Commissary, Diocesan, or Consistory courts. Bishops' courts were the highest court within each diocese.

The Prerogative Court of Canterbury, the highest court of all, was used for wills of testators who died or owned property outside of England.

*Marriage Licenses are only dispensations from the proclamation of Banns.

After 1664, until 1783, the English governor of New York, America; collated Benefices and granted Licenses of Marriage, and Probate of Wills.

Previously the Dutch at New York, permitted marriage in churches, and at the Courts.

"Between 1620 and 1622, over 150 "pure and spotless" white women were brought to Virginia and auctioned off to men for an average of 80 pounds of tobacco."

There was no framework in early Newfoundland, for Banns or Licenses. Livyers/Liviers( inhabitants living here ) could sojourn to England for Marriage.

Or have a civil marriage at Newfoundland, under a missionary, Admiral, layman, Minister, etc. Civil marriage occurred in England, during the time of Cromwell.

*August 3, 1693. Sir Francis Wheeler's squadron sailed from Boston and tried to take Placentia at Newfoundland in vain. His men were sick. Francis once wrote: "So Long as there comes no women they are not fixed." ( As in fixed to the husband, household, fishery, community, etc. Ie: permanent settlement. Newfoundland resident population checking, by the English. )

*From 1633, the Bishop of London was held to have responsibility for Anglican Parishes overseas, where no local bishop had been appointed. The Bishop of London was also responsible for un-parished Newfoundland, until 1787, when the Diocese of Nova Scotia was created, and Newfoundland was placed under the care of the Rev. Charles Inglis. 154 years wherein no Parish was created for resident Newfoundlanders. When the French laid officially channeled complaints to the English/British Crown of those residents in Newfoundland, who were interfering with the French right to Fish, the official reply of the English Crown, was that there were no permanent settlers in Newfoundland. Only temporary Fishermen. ( No permanent settlers required no Parish. ) The hands of the Bishop of London, were in effect tied. The Anglican Canon Laws of England, did not apply to overseas Newfoundland. Early Newfoundland was simply a worksite, to keep bread on the table, for those English West Country folk who ventured to the Newfoundland Fishery, inclusive of some Londoners.

*Have any Newfoundland marriage Bonds, or License records, survived within Nova Scotia Archives?

Terrence M Punch's book. Page 85. Genealogical research in Nova Scotia...

Surviving Marriage Bonds for 1763, 1765, 1770-1780, 1782, 1784-1799, 1801-1850, 1854-1856, 1858-1864 are held by the Public Archives of Nova Scotia.

A microfilm series has many of these bonds arranged alphabetically by groom's names. No cross reference by bride's name exists. The bonds frequently

give the groom's trade or occupation, while witnesses and sureties were often relatives of the parties planning marriage.

*The first bishop of Newfoundland, the Rev. Aubrey George Spencer, was consecrated in 1839. 229 Years, after 1610. For some 200+ years, the English West Country Newfoundland men, managed to keep the Newfoundland Fishery largely to themselves. Bread on their table. )

*Two or three apparent marriages showing up in familysearch, for the same couple?

Consider 3 consecutive Weeks Banns in a community; Was a marriage license acquired, and where?; & the actual marriage ceremony in a community.

*Protestant dissent, or non-conformity, essentially originated in England, with the Act of Uniformity, of May 19, 1662. By this Act, episcopal ordination for all ministers ( dissenting clergy ) was required. Earlier, Ministers, not of Church of England persuasion, commonly preached to some English communities.

Note: Minister/Pastor = dissenting; as opposed to Priest, Vicar, Chaplin, Rector, etc. = Church of England. Thus the great ejection of 1662. Due to the substantial number of newly created dissenters, this era was styled as the beginning of non-conformity, in England.

*At Foxton, Northamptonshire, several leaves of the register from 1697 are headed: Those set down in the register "only born", were baptized by

Nonconformist ministers. ( Note: A general theme seen in many early English Parishes. )

*Aug 10, 1840. The Act of the 3rd and 4th Victoria, cap. 92, legalized the non-parochial registers of England. ( Non Church of England registers ).

An Act passed in the Session of Parliament held in the Third and Fourth Years of Her Majesty (Chapter Ninety-two), for enabling Courts of Justice to admit Non-parochial Registers as Evidence of Births or Baptisms, Deaths or Burials, and Marriages. Provisions were made for the Deposit in the General Register Office of certain Non-parochial Registers, and for making the same receivable in Evidence. This Act did not pertain to Ireland or Scotland. Previously such nonconformist registers, were not legal in England. Though they are known to have been kept. *Consider Newfoundland Church Registers, in such context.

*It is interesting that in the 1836 Notre Dame Bay Fishing Room Census, almost all residents were classed as Church of England folk. When many were actually non conformists, or protestant dissenters. Consider why the Justice of the Peace, Peyton; would create such a false, biased listing? Dissenterism was still being stymied. Even post 154 years, of no Parochial structure, for the early resident Newfoundland settlers, to perform worship.

*In 1700's English records, storehouse and warehouse, were used interchangeably. The many Storehouse Islands around the coast of Newfoundland,

in early times, were sites where salted Cod would have been warehoused. Until sold to the merchant, or to a Sack ship.
