IN RE: JAMES BUTT DECEASED
Testament of James Butt, Merchant of Bonne Bay. District of St. Barbe. This is the last will and testament of me James Butt.
1st. I appoint my two sons, namely George C. Butt, and Walter Butt to be the executors of this my will.
2nd. I will and desire that all my just debts be paid out of my estate.
3rd. I will desire and bequeath unto George C. Butt, and Walter Butt, the following named properties. Shoal Point. Consisting of land, houses, factories, and fishing outfits, valued at $1000.00. Also at Trout River, consisting of lands, shop, stores and building thereupon, together with the dry goods, groceries, provisions, hardware, and fishery outfits of every description valued at $10,000.00. Except the dwelling house occupied by my
son George C. Butt, which is his exclusive property. Also property situate at Winter house Brook, consisting of about four acres of land with dwelling house, and outhouses thereupon valued at $2000.00. Also my business premises, situate at Woody Point, consisting of lands water front, with all buildings, thereupon, shop, stores, wharves, and boats of every description. Stocks of dry goods, groceries, provisions, hardware, and fishery outfits, valued at $60,000.
4th. I will devise and bequeath unto my two sons, George C. Butt, and Walter Butt, all of the aforementioned properties, in the third section of this my will valued $73,000. To be equally divided between my said sons, George C. Butt, and Walter Butt.
5th. I will devise and bequeath unto my son Walter Butt, my dwelling house situate at Woody Point, valued $3500. To be his exclusively at my decease.
6th. I will and desire that the advances made by the firm of Butt Brothers, Bonne Bay. To Joseph H. Brake of Meadows Point about $5000, is a part of my estate, and to be applied in the same manner as provided by the fourth section of this my will.
7th. I will desire and bequeath unto my married daughter Beatrice Brake, at Meadows Point $1000, to be paid out of my estate.
8th. I will desire and bequeath unto my married daughter Jane Ann Creaker, of Trout River $2000., to be paid out of my estate.
9th. I will desire and bequeath unto my unmarried daughter, Mary Elizabeth Butt. $3000. same to be paid out of my estate.
10th. I will desire and bequeath unto my unmarried daughter Dinnath Butt, $2000. to be paid out of my estate.
11th. I will and desire, that the insurance life policy of my son George C. Butt, for $2000. payable to me in the event of his death. The said sum to be at the disposal of the said George C. Butt.
12th. I will and desire that the insurance life policy of my son Walter Butt, for $2000, payable to me in the event of his death. The said sum is to be at the disposal of the said Walter Butt.
13th. I will desire and bequeath that all the rest residue and remainder of my estate of which I shall be possessed of, or to which at the time of my death I shall be entitled to, and to be applied in the same manner as provided by the 4th section of this my will.
14th. I will and desire that all the foregoing sections of this my will be carried out as expressed within reasonable time after my decease.
