In re: WILLIAM BURGE. DECEASED

In the name of God Amen, I Willim Burge late of Marnhull near Sturminster Newton in the County of Dorset, but now of Twillingate in the Northern District of Newfoundland, Planter, being of sound mind memory and understanding considering the uncertainty of human life do make this my last will and testament in the manner following, that is to say,

First, I give and bequeath to William Wells my son in law, all that portion of my fishing room which he at present occupies and dwells upon together with all the buildings thereon erected of what ever kind or description, to hold to him his heirs executors or administrators for ever.

Secondly, I give and bequeath to James Inder my son-in-law one half of my fishing stage, together with all that space of ground situate between that portion of my fishing room now occupied by William Wells aforesaid and the Road or pathway leading down to my fishing stage, also the dwelling house in which he now lives, and all other buildings situated on that said space of ground, and now in his (James Inder*s) possession, to hold to him, his heirs executors or administrators for ever.

Thirdly, I give and bequeath to my beloved wife Martha Burge all the remaining part of my fishing room not herein already disposed of with all the buildings thereon, together with all the meadows and gardens now in my possession for and during the term of her natural life Also I give to her all my nets, seans, boats and fishing tackle of every description, together with all my household furniture, beds, bedding, clothing and silver plate. &c. &c.

Fourthly, I give and bequeath to my two grandchildren William House and Mary Anne Drake jointly and equally all that part of my fishing room herein bequeathed to my wife during the term of her natural life as aforenamed, together with the meadows and gardens also bequeathed to her, to hold to them their heirs, executors or administrators for ever.

Fifthly, it is my will that whatever portions of my property may remain at the time of my wife*s death, not being already herein finally disposed of, these portions whether consisting in nets, seans, boats, fishing utensils or any other moveables, or in monies, debts, dues or claims shall be divided into five equal parts and there shall be given to my daughter Mary Wells one part, to my daughter Martha House one part, to my grandson William house one part, to my granddaughter Mary Ann Drake one part, and to my three grandchildren Job Inder, Asenath Inder and Isabella Inder jointly and equally amongst them one part also.

Lastly, I do hereby nominate constitute and appoint John Peyton, Enquire, and my son-in-law John House both of Twillingate executors of this my last will and testament hereby revoking and disallowing all other wills by me at any time heretofore made.

In witness whereof I the said William Burge have to this my last will and testament set my hand and seal this first day of March in the year of our Lord one thousand eight hundred and thirty nine

Signed, sealed, published and declared by the said William Burge the testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses,

This is a codicil to the last will and testament of me William Burge (bearing date the first day of March in the year of our Lord one thousand eight hundred and thirty nine) and which I desire may be considered as part of my will. Whereas since making my said will James Inder my son-in-law therein named has departed this life, It is my will that the portion of my fishing room and premises as already specified in my said will and there bequeathed to the said James Inder shall now at my decease become the pr operty of my three grandchildren Job Inder, Asenath Inder the wife of George Oxford and Isabella Inder, jointly and equally amongst them to hold to them their heirs, executors or administrators for ever.

In witness whereof I the said William Burge have to this my codicil set my hand and seal this fifth day of July in the year of our Lord one thousand eight hundred and fifty one.
