Will of Thomas Malcolm

In re: THOMAS MALCOLM DECEASED

I Thomas Malcolm Doctor of Medicine of Fogo, in the Island of Newfoundland being of sound and disposing mind and memory, do make and publish this as my last will and testament hereby revoking all former wills by me made

(1) I hereby appoint my wife Annie E Malcolm and my son Fred F. Malcolm to be the executors of my will.

(2) I hereby direct my executors to pay all my just debts as soon as possible after my decease.

(3) I hereby bequeath my house and premises known as Lowland House in the town of Fogo to my wife Annie E Malcolm during her natural single life, and after her decease to my son Fred F. Malcolm, absolutely.

4. I devise and bequeath my property known as "Melbourne Ranch" three miles East of Santa Paula in the county of Ventura Southern - California to my son Arthur D Malcolm and direct that he pay annually from the fruit proceeds Two hundred dollars for the maintenance of my wife Annie E Malcolm during her unmarried life, or widowhood, after that to become his absolutely forever.

(5) I further bequeath to my wife Annie E Malcolm all the rest and residue of my real and personal estate to be disposed of as she may think proper, the proceeds to go towards the support of herself and family

(6) I further direct that my executors leave my life Insurance policy money in the hands of the Company and draw the interest at 4 per cent annually for the support of my wife and family If that cannot be satisfactorily arranged that they draw from the company the whole amount and deposit it in a Savings bank for safety and collect the annual interest, and draw such small amounts as may be required from the capital for the maintenance of my wife and family

(7) Should my wife Annie E Malcolm marry again she forfeits all claim to any of my money or property which will then be divided equally between my children Netta Y Jones, Emily Malcolm, Fred Malcolm and Thomas W Malcolm, share and share alike except the Ranch at Santa Paula which is to become the property of my son Arthur D Malcolm for ever.

8. Should my wife Annie E Malcolm not marry again any money left from Life Insurance Policy or money deposited in Banks at her decease shall be divided equally between my surviving children Netta Y. Jones, Emily Malcolm, Fred F. Malcolm and Thomas W. Malcolm share and share alike

(9) I further direct my executors to draw the Interest of any money deposited in Savings Banks annually for the maintenance of my wife and family In witness whereof I have hereto set my hand and seal this 23rd day of September A.D. 1905. Thomas Malcolm (LS) Signed, sealed published and declared by Thomas Malcolm as and for his last will and testament in the presence of us present at the same time who at his request in his presence, and in the presence of each other have hereto subscribed our names as witnesses to the due execution hereof John W Hodge Ernest E Hyde.
