In re: SIMON JACOBS. DECEASED
This is the last will and testament of Simon Jacobs of Twillingate in the Northern District of the Colony of Newfoundland.
First I give and bequeath to Mary Ann my wife all my right title and interest in the dwelling house I now reside in situated in Farmers Arm, Twillingate aforesaid, together with all other houses and buildings gardens and lands thereto appertaining and my household furniture goods and chattels my fishing room and all my craft also all my cattle debts dues and claims in short whatever is mine or whatever I may have any lawful claim to at the time of my death (except what I dispose of in this will) I give and bequeath to Mary Ann my wife during such term as she shall remain unmarried after my decease But it is my will that if she shall marry after my decease then the aforementioned right title and interest in the dwelling house, other houses buildings gardens and lands thereto appertaining and my household furniture goods and chattels, my fishing room and all my craft also all my cattle debts dues and claims (except what I dispose of otherwise in this will I give and devise the same unto and to the use of my executors (to be hereafter named) in trust for my sons Jonathan Jacobs and Solomon Jacobs until they shall respectively attain the age of twenty one years then equally to be divided between them for their mutual benefit so long as they shall live together upon the aforementioned premises or to the son who shall continue to remain on the said premises
It is also my will that my daughters Lydia Jacobs and Phoebe Brewster Jacobs being unmarried shall have a right to live and reside in my dwelling house if they or either of them see proper and convenient so to do during such time as they or either shall remain unmarried rendering such reasonable assistance as may be in their power and to receive a maintenance therefrom.
I give and bequeath to my brother Thomas Jacobs one third part or share of my schooner called the "Faith" for his own absolute use and benefit the remaining two thirds I give and bequeath the same unto and to the use of my executors in trust for my sons Jonathan and Solomon until they shall attain the age of twenty one years and for the mutual benefit of my wife Mary Ann and my children subject to the proviso of her remaining unmarried after my decease.
And lastly I do hereby nominate constitute and appoint John Roberts and James White both of Twillingate executors of this my last will and testament.
