Will of John Philpott from Newfoundland will books volume 10 pages 263-264 probate year 1914

In re     JOHN PHILPOTT      deceased.

This is the last will and testament of me John Philpott, of Herring Neck, in the District of Twillingate in the Island of Newfoundland, Planter. I direct that my testamentary and lawfull debts be paid as soon after my decease as possible.
Firstly- I devise and bequeath to my wife Emma Philpott whatever monies I leave in the dwelling house, also the said dwelling house I now occupy together with the furniture in it, to be her own during her lifetime, after her death to become the property of my daughter Jane Batt.
Secondly- I give and bequeath to my daughter Malvina Rendell, wife of George Rendell now residing in Twillingate the sum of Five hundred dollars- should it not be spent at her death it shall go to her children.
Thirdly- I give and bequeath to my daughter Charlotte Farthing wife of Isaac Farthing, the dwelling house in which she now lives, the store, or shop, now occupied by William Ashbourne, the stage which her husband built, and occupies, and the land on which these buildings stands, and no more, except a passage to walk to the said stage & store- the sum of Three hundred dollars, and one fourth of my garden in the Wallet, Goshens Arm, Herring Neck.
Fourthly- I give devise and bequeath to my daughter Fanny Stuckey, wife of Stephen Stuckey, the sum of Five hundred dollars, and one fourth of my garden in Wallet aforesaid.
Fifthly- I give devise and bequeath to my daughter Lydia Martin wife of John Martin, now residing in Gloucester, Mass U.S.A. the sum of Five hundred dollars.
Sixthly- I give devise and bequeath to my daughter Jane Batt, wife of Robert Batt, Five hundred dollars.
Seventhly- I give devise and bequeath to my son-in-law Eli Blandford the land his dwelling house stage and outhouses stand and waterside lying to the Northwest of my store in which I repair my Nets and Traps.
Eighthly- I give devise, and bequeath to my son-in-law Robert Batt, all my fishing Room and land (save and except that bequeathed to my daughter Charlotte Farthing and to my son-in-law Eli Blandford before mentioned) also my schooner “Lily Dale”, Cod Traps, Nets, Boats, Flakes, stages and whatever Fishing property I die possessed of, also one-half of my garden in the Wallett or Goshens Arm.
Ninthly- I give devise and bequeath to St. Mary’s Church and the Parish of Herring Neck the sum of One hundred dollars to be used for the benefit of the said Church, as the Clergyman and Church Wardens may in their discretion see fit.
Tenthly- I further direct that whatever monies may be left after the before mentioned legacies are paid- shall be paid to my wife Emma Philpott, aforesaid.     I appoint Thomas Hussey and Robert Batt to be my executors.     In witness whereof I hereunto set my hand this fifth day of June in the year of our Lord one thousand nine hundred and nine.     John his X mark Philpott.     Signed by the said John Philpott the testator by affixing his mark thereto, after being read over to the said testator and explained, who in our presence, and in the presence of each other, subscribe our names as witnesses     Louis G. Codicil After consideration, I hereby direct this as a codicil to the above Will- That the garden near the shop occupied by Wm Ashbourne shall belong to my daughters Charlotte Farthing and Fanny Stuckey share & share alike     John his X MARK Philpott     Witnesses Louis G. Hyde     Joseph P. Farthing.
