Will of John Pelley of Christchurch, Southampton; Fogo Planter, October 17, 1737.
In the name of God Amen, I John Pelley of Winkton in the parish of Christchurch Twineham, in the County of Southampton, Newfoundland Planter; and now in Fogo, being in perfect health Sense and Memory, thanks be to Almighty god for the Same. Knowing the Uncertainty of this frail and Mortal life, am Desirous and willing to Devise and Settle my Effects, goods, or Chattels; by this my last will and Testament, in Manner and form following. ( That is to say ). First of all, I give Devise and bequeath Unto my two Eldest sons John and Thomas Pelley, all that my room or plantation Situate, lying, and being in the Harbour of Fogo aforesaid, in the Newfoundland, in America. In a Cove there called Pelley’s Cove. Equally to be divided between them. But my Eldest son John Pelley shall have the first Choice of such the two boats rooms; and Thomas the other part. Also, I Give Devise and bequeath unto my said sons John and Thomas Pelley, both of my Boats or Shallops now by me set out. And Sent abroad on a Sileing[Falling, Felling, logging ], Sawing, and boatbuilding Voyage, this Winter Season Ensuing. And the product, benefit, and Gains thereof, ( of any ), shall be and remain to and for the Use of my Said Wife Mary Pelley and my two young Children. ( That is to say. ) Mary and James Pelley. Equally to be Divided. My wife Mary Pelley paying all the Servants wages by Me agreed, on such Winter Voyages. Also, I give Devise and bequeath unto my Said wife Mary Pelley all that my house or Tenement Situate, and being at Winkton, in the parish of Christchurch aforesaid. Together with all the goods and Chattels. As also, all Edifices and buildings, gardens & Meadows, or Pastures ground, whatsoever thereto belonging or appertaining. For and during such term, or so long as my wife shall Continue a Widow, after my Decease. But when Married, then Immediately the Same Tenement shall be for the Use of My Daughter Mary Pelley. Then when in her Custody or possession, she my Daughter, Shall pay unto my son James Pelley twenty pounds sterling. To and for his Use within one Month after so in possession. Also, I give Devise and bequeath Unto my Said Wife Mary Pelley, all Sum, and Sums of Money now in the hand, Custody, or possession, of William Kittier of Ringwood, in the Said County of Southampton, Mercer. As also all, and all Manner of Debt, or Debts, Sum, or Sums of Money, bills, or bonds, whatsoever, or hereafter now to Me of right belonging; or that may hereafter belong, or Appertaining. But provided, and my will is that if my Said Wife Mary Pelley should happen to Marry after my Decease; then all Sum, or Sums of Money now in the hands of William Kittier, as also all other Sum, and Sums of Money, Bills, or Bonds, to me owing, or that hereafter May become Due, shall be for the Use of my four Children. ( Viz. ) John Pelley, Thomas Pelley, Mary Pelley, & James Pelley. Equally to be Divided. I do hereby Constitute, Ordain, and appoint my beloved wife Mary Pelley, my Sole Executrix of this my last Will and Testament. And I do hereby Utterly disallow, revoke, and disannul, all and every other Will and Testament heretofore by Me Made; but do Confirm this only to be my last will and Testament. In Witness whereof I have hereunto Set my hand and Seal, this Seventeenth Day of October, in the tenth year of the reign of our Sovereign Lord George the Second, by the grace of god of Great Britain, France, and Ireland, King Defender of the faith and so forth. And in the year of our Lord one thousand Seven hundred and thirty Seven. Signed and Sealed by John Pelley. Signed, Sealed, and declared by John Pelley the Testator as his last Will and Testament in the presence of Us: Charles Bullock, John Garrett Blake, James Dean, John Ginn. *The executrix for John Pelley was sworn on March 5, 1738/9, for grant of Admon.
