Will of John Gilliard from Newfoundland will books volume 10 page 323 probate year 1915

In re     JOHN GILLIARD      deceased.

    I John Gilliard, of Gilliards Cove, Twillingate in the Northern District of the Island of Newfoundland, make this my last will and testament, while in the possession of sound mind and memory, this 13th day of May in A.D. 1910. I give and devise my property situated at the above named place as follows. (1) I give and devise unto my wife Lydia Gilliard, and my two daughters Annie Gilliard and Lydia Gilliard one half of my garden known as Ashbourne’s garden, on the north side of the said garden. (2) The big potato garden, cabbage garden little garden by the waterside, dwelling house and outhouses, also one third of the waterside.     But should my wife marry again and take with her my daughters above named then my executor is hereby empowered to sell the property given and devised unto my wife and two children above named, and to use the money for the support of my children named.     If my wife die, the property is also to be sold for the support of my two daughters Annie and Lydia Gilliard, if one of my daughters above named die then her portion is to be the property of the remaining child and my wife if she continues my widow.
    (2) I give and devise unto my sons John Gilliard the part of Ashbourne’s garden on South side commencing to the fence and going North about seven yards as per posts placed in the said garden;     Also in the inside garden, on the side adjoining Obediah Young’s land according to division made in April 1910.     The said Obediah Young is to have a right of way to the well in the above garden, commencing at an angle at the well & going towards the public road for 12 yards then to the boundary fence, or 12 yards square.     To my son Elijah Gilliard I give and devise a piece of Ashbourne Garden adjoining the part given to my son John Gilliard seven and one half yards wide and running parallell to the part given to John Also the part of water side premises now occupied by each of my sons John Gilliard and Elijah Gilliard is to be theirs forever     My son Elijah Gilliard is to have the part of the inside garden next adjoining my son John Gilliard or the middle portion of the garden as per division made April 1910 A.D.     Lastly I hereby appoint and constitute Charles White my executor (whose decisions in all matters shall be final) to be my sole executor of this my last will and testament In witness whereof I hereunto set my hand this 13th day of May 1910 A.D.     John his X mark Gilliard Signed in the presence of George Guy     Alex Guy
