In re: FREDERICK GUY. DECEASED
I Frederick Guy of Twillingate in the Northern District of the Island of Newfoundland being of sound mind and memory, do make this my last will and testament, in manner and form following, that is to say:
(1) I give and devise my upper room consisting of cultivated land and water-side premises to my sons George, Robert, Alex and Charles Guy to be equally divided amongst them; but the part of land not fenced nor cultivated is to be shared equally amongst all my sons, with this exception Thomas Guy is to have sufficient room to build a house thereon and right of way to the same.
II I give and devise the lower premises as follows;
- To my son Stephen one-half the lower two plots of potato ground.
- To my son James the remaining half of said potato plots.
- To my son Frederick and my grand son Robert Lambert the upper plots of potato ground divided equally.
- The remaining land and waterside premises, except hereinafter mentioned, to be equally divided and used amongst my sons Stephen James and Frederick Guy also my grandson Robert Lambert.
- III I give and devise unto my son James Guy the part of dwelling house now occupied by me the said James Guy and family.
- To my son Frederick Guy the other part of said dwelling house:
- To my grand son Robert Lambert the dwelling house now occupied by George Hodder Jr. also the shop and land upon which they are situated when he becomes of age and all rentals derived from the same except such as shall be deemed necessary to effect repairs on the same, by my Executor in the mean time
- The building known as the Coopers shop is to be equally divided amongst my sons Stephen James and Frederick Guy
- I give and devise unto my grand-son Robert Lambert my bed and bedding.
- IV I give and bequeath unto my son James Guy the sum of eighty dollars.
- To my grand sons Robert Lambert and Harry Guy (son of James) the sum of eighty-dollars each.
- To my daughters Jane Taylor and Rebekah Jenkins the sum of forty dollars each.
- To each of my other sons the sum of ten dollars each should any money be left after the above distributions and my expenses are paid it is to be equally divided among my sons and daughters surviving me.
- All the rest, residue and remainder of my property real and personal I give devise and bequeath unto my sons Stephen, James Frederick Guy and my grandson Robert Lambert.
Lastly I constitute and appoint Charles White my sole executor of this my last will and testament and desire that he shall not be required to give any security for the performance of his duties. In witness whereof I hereunto set my hand this 4th day of September 1906 A.D. Frederick his X mark Guy. Signed by the testator by making his mark after first being read over and explained as his last will and Testament who in his presence and in the presence of each other have subscribed ourselves as witnesses thereto Elias Young Elias Wheller.
Codicil
Whereas I, Frederick Guy, did on the 4th day of September 1906 make my last will and testament. I do now by this writing add this my codicil to my last will to be taken as a part whereof.
Whereas I did bequeath unto my sons and daughters the remainder of my money after the distribution of amounts named I do now give and bequeath unto Maria Guy wife of James Guy the sum of twenty dollars all the rest remainder and residue I give and bequeath unto my son James Guy with the exception of my horse and carriage which I give and devise unto my grandson Harry Guy, son of James Guy. It is understood that my grandson Robert Lambert is to have possession of his Legacy and property at the age of twenty one years. Should either one other of my sons or grandsons leave the premises then it is to remain the possession of the other sons or grandsons remaining on said property.
In witness whereof I hereunto set my hand this nineteenth day of September 1906 A.D. Frederick his X mark Guy Signed and declared to us by the testator Frederick Guy as and for a codicil to be annexed to his last will and testament by making his mark afer being first read over and explained. And we at his request and in his presence and the presence of each other have subscribed our names thereto as witness of the same Elias Young. Walter Young. witnesses
