Will of Francis Berteau

In re: FRANCIS BERTEAU. DECEASED

This is the last will and testament of me, Francis Berteau of Twillingate Newfoundland Stipendiary Magistrate. I give devise and bequeath as a special bequest to my son Francis Cyrus Berteau for his own use absolutely, all my Illustrated London News, bound and not bound, also all my library, with the exception of those marked in my wifes name, who are to go to my two daughters, and all other books marked in my other childrens names also the oil paintings of myself, and my late wife, painted by my Brother Thomas Berteau.

2nd I give devise and bequeath, as a special bequest to my son Edwin Hugh LeGoyt Berteau for his own use and benefit my Dressing Case with all its contents including all my own jewelry, also give devise and bequeath to him, my Fathers and Mothers portraits painted by my Brother Thomas Berteau also two Water Colour Marine Views by John LeCapelain (these marked by me) also give him my Worcesters Dictionary, and my Rose wood writing desk.

3rd I give devise and bequeath, as a special bequest to my son Ernest Falle Berteau my Gold watch, chain, and appendages, for his sole use and benefit, also give him the oil painting of Grandmother Cabot painted by my Brother Thomas there are other pictures in the House marked in his name given to him previously, also give him my travelling Desk.

4th I give, devise, and bequeath, as a special bequest to my son Albert Le Capelain Berteau, for his absolute use and benefit, all the law books, or any in connection with the law belonging to me, also give him for his own use and benefit, my oil painting of the Fisherwoman, painted by my Brother Thomas, also my Solid Silver Gravy spoon marked F.B.

5th I give devise and bequeath as a special bequest, to my daughter Mary Le Capelain Berteau, now Mrs. W.A. Scott of Moncton N.B. The Crayon portrait of my wife and the drawing of herself both drawn by my Brother, and the oil painting of Eli & Saul by John Le Capelain, for her absolute use and benefit Also give my said daughter Mary Le C. my small mahogany Chest of draws bought in Jersey for her, and the albums of Jersey Views, given me by my nephew Albert F. Grelliex.

6th. I give devise and bequeath as a special bequest to my daughter Lydia de Gruchy Berteau for her own use absolutely and disposal of, should she find it necessary to do so for her support, all books marked in my wifes name, also all the Books I have marked in her name & also the Bible given me by Bishop Field I also give and bequeath to her for her use and benefit the Hair picture of Daunerouse. The Crayon portrait of Uncle Samuel, by John Le Capelain and Two water Colour Views in deep gilt frames by J Le Caplain. I also give and devise to my daughter Lydia de G Berteau the Ladies Mahogany wardrobe, and my mahogany Chest of Draws, for her sole use and benefit.

7th I further give, devise, and bequeath to my daughter Lydia de Gruchy Berteau, the residue of all my household Furniture, Silver and plated ware, Glass-ware, Linen, all kind of beddings beds, tables and other house-hold Linen, pictures, and effects of every description not previously disposed of by me, in this my will, for her own use and benefit; but should she get married, whatever she may have remaining of my property shall be divided in Six equal shares according to value between my six surviving children, or their Heirs, in the event of her dying Single, then the property, is to be divided in five equal shares according to value, between my five surviving children, or their Heirs.

8th I give, devise, and bequeath to my daughter Lydia de G Berteau for her sole use, and benefit, whatever monies I may have due me in the Bank of Montreal at St. John’s Nfld. or from any other Source after my just debts, and funeral expenses are paid it being my wish to be buried in St. Johns Nfld if circumstances permit.

9th I give, devise, and bequeath to my daughter Lydia de G Berteau for her sole use and benefit my Three Stores, or buildings which I now occupy, having been built by me at my expense in Back Harbour, and brought thence, on the land owned, and with the consent of the late John M Nurse, to be removed by me at any time I should leave Twillingate, or die my daughter to sell them, or remove them at her expence, for her benefit.

10th all my Carpenters, and other Tools, at my death, except, those for the use of the house are to be divided in three equal shares according to value between my three sons, viz F.C. Berteau Edwin H. Berteau and Albert Le C. Berteau all living in St. John’s Nfld for their sole use and benefit.

11th And I appoint my son Edwin H LeGoyt Berteau sole executor to this my last will and revoke all previous wills by me at any time heretofore made. In witness whereof, I hereunto set my hand this Twenty-first day of March in the year of our Lord one thousand nine Hundred and Two (sgd) Francis Berteau Signed by the said Francis Berteau the Testator in our presence and in the presence of each other the word use on the first page, being interlined previous to the testator signing the will at the same time subscribe our names as witnesses.
