IN RE:   MATILDA CLUETT.    DECEASED

In the name of God. Amen. I Matilda Cluett of Belleoram being in my right mind and having all my faculties intact for which I thank God, do hereby make my last will and Testament in manner and form following: thereby annulling all former wills made by me:

1st I give and bequeath to my nephew John Rupert Cluett my Bedroom Sett. Bed and bedding enough to furnish one Bed

2nd To my surviving sisters I give and bequeath the rest of my household belongings to be divided equally among them.

3rd The parcel of land situate in Bay-de-East Fortune Bay, also my part of store and wharf, situated between property of Philip Rose and property of children of William and Charlotte Cluett at Belleoram. I give and bequeath to my nephew John Rupert Cluett.

4th Of the money lying to my credit in Bank of Montreal Savings Department. I give and bequeath The sum of one Hundred Dollars for the purchase of a Brass Spread Eagle Lectern to be placed as a memorial of me in the Church of St. Lawrence at Belleoram The balance remaining to be divided equally between my nephew John Rupert Cluett, Ida Bishop daughter of the Late Rev John Bishop, and the party who takes care of me till my decease.

5th Of the money lying to my credit in the Bank of Montreal I give and bequeath to the Church of St. Lawrence at Belleoram the Sum of Four Hundred Dollars ($400.00) The principal is to remain in the Bank the Interest only shall be used in keeping the Graves and Graveyard in decent order. (This applies only to the Graveyard on the Hill)

6th That Four Hundred Dollars be given to the Synod for Home and Foreign Mission Fund

7th That Four Hundred Dollars be placed in the Bank of Montreal Savings Department in the name of the Executors to be used at said Executors discretion for the maintenance of Thomas Alexander Cluett and Clara Cluett, my sister Charlotte Cluett's children. In case of the death of both & any money remaining the said money shall go to their brother John William Cluett

8th That my sister Mrs Agnes Grandy Susanna Cluett and Sarah Rose (or their heirs) shall each receive the Sum of one Hundred Dollars

9th That the sum of Twenty Dollars be paid for a headstone for my sister Charlotte Cluett and her husband William Cluett, and their child Albert Aaron Cluett

10th That the Sum of one Hundred Dollars be given (to Esther Grandy, or in case of her death to her daughter Sabina Matilda Cluett Grandy, of Garnish.

11th Should there be any Balance left after all funeral expenses and costs of headstone are defrayed the executors are to use it to best advantage in furthering the work of the Church of England in Belleoram and its dependent settlements.

12th I give and bequeath my small ring to Mrs Matilda Whatley.

13th I hereby appoint Levi Angus McCuish and Frederick Curnew joint executors of this my last will and testament to which I have hereunto set my hand and seal this Eighteenth Day of November, in the year of our Lord one thousand nine Hundred and seven Matilda Cluett. Codicil to be affixed to the will of Matilda Cluett of Belleoram I Matilda Cluett being of sound mind and memory hereby make this deed as a Codicil to my last will and Testament made and dated on 18th day of November 1907

This Codicil is to alter certain sections of said will and is to be taken as part of same. Section 4 of said will is hereby annulled, and the amounts bequeathed thereunder are to be disposed of as follows:

(a) The sum of Four Hundred Dollars I give and bequeath to my nephew John Rupert Cluett

(b) The sum of four Hundred Dollars to Ida Bishop daughter of Rev John Bishop and Elizabeth Bishop widow of late Rev. John Bishop to be divided equally between them.

( c) The sum of Four Hundred Dollars to be used (at the Executors discretion) in placing necessary furniture in the Chancel of the church of St. Lawrence and in memory of my family

(d) The sum of Two Hundred Dollars to my niece Frances May widow of late Wm Geo. May

(e) The remaining two Hundred Dollars will remain in the Bank (at my disposal) but if not used at the time of my decease the Executors are to add it to the Four Hundred Dollars to be used in the Channel aforesaid.

Section 2 is also annulled and the matter contained therein will be disposed of as follows. "Whatever household belongings are about me at the time of my decease the executors are required and directed to hand over to my nieces Agnes Burdock and Frances May to be disposed of as I have directed them.

Section 8 is also annulled; and the amount of Three Hundred Dollars mentioned therein is to be left in the Bank for my own personal use. Should there be any of the above amount remaining at the time of my decease it may be disposed of under Section 11.

In Section 10 the sum of one Hundred Dollars has been willed to Esther Grandy or her daughter Sabina Matilda Cluett Grandy I hereby annul Section 10 and I give and bequeath the sum of One Hundred Dollars to Sabina Matilda Cluett Grandy daughter of Esther Grandy of Garnish.

Lastly it is my desire that this my present codicil be annexed to and made a part of my last will and testament to all intents and purposes. In witness whereof I have hereunto set my hand and seal this Eleventh day of June in the year of Our Lord one thousand nine hundred and nine Matilda Cluett (LS) The above instrument of one sheet was at the date thereof declared to us by the testator Matilda Cluett to be a Codicil to be annexed to her last will and testament and she acknowledged to each of us that she has subscribed the same and we at her request sign our names hereto as attesting witnesses Frederick Curnew J.P. of Belleoram Levi Angus McCuish of Belleoram
