Will of James Gaulton

In re: JAMES GAULTON. DECEASED

The will & Testament of James Gaulton, Senior. I, James Gaulton now Resident on Brunett Island, District of Fortune Bay Newfoundland, late of Path End, Burin. In good health & sound mind. Do by these presents will and bequeath all my right and title to the premises, now belonging to me, and in the present occupation of Mr George Brushett and Mrs. James Alfred Gaulton situated in Path End, Burin. To my daughter Martha, wife of the aforesaid Mr. George Brushett, and to the children of my son James Alfred Gaulton, deceased, namely, George Bradley Gaulton, John Albert Gaulton, Reuben Thomas Gaulton, James Howard Gaulton, & Charles William Gaulton. To their heirs & assigns for ever, as follows, To my daughter Martha Brushett aforementioned her heirs & assigns for ever, that is to say. From the central stone mark which I, James Gaulton have placed at the western extremity now occupied by my daughter aforesaid Martha Brushett, wife of the aforesaid Mr. George Brushett this is specification of the waterside boundary.

With respect to the land - From the land now occupied by Mr. James Brushett (Jersey) on the East Side to the corner of the garden now in the possession of the said Mr. George Brushett western side, to the eastern corner of the garden of the late James Alfred Gaulton included To my Grandchildren, the aforesaid George Bradley Gaulton, John Albert Gaulton, Reuben Thomas Gaulton, James Howard Gaulton and Charles William Gaulton, their heirs & assigns for ever - Specification of water side boundary. From the aforementioned Central Stone Mark on the Eastern Side, to the boundaries of the late Thomas Brushett (Senr) on the western Side. Specification of the Land. From the garden in the possession of the said Mr. George Brushett on the Easter Side to the boundaries of the late Mr. Thomas Brushett (senr.) on the western Side.

I James Gaulton, aforesaid do further desire that my property which I have now bequeathed to my grandchildren afore-mentioned shall be equally divided amongst the brothers aforesaid as follows. Two fifths to the two brothers, namely, George Bradley Gaulton & John Albert Gaulton which portion they can have when they come to age. The remaining three fifths to the three brothers, namely, Reuben Thomas Gaulton, James Howard Gaulton, and Charles William Gaulton, which portion of the property they can have when of age.

I, James Gaulton do further will and declare that the widow of my son the aforesaid James Alfred Gaulton, shall hold possession of and with her children retain the half of my property as now bequeathed so long as she remaineth my son’s widow, and no longer. Signed and sealed this eighth day of November one Thousand eight hundred and Seventy nine Sign and seal of James (LS) Gaulton Senr. In the presence of Jesse Thornton Thomas Bradley witnesses

Codicil; I, James Gaulton, of Brunett Island in the District of Fortune Bay, Newfoundland, do further declare that on no account whatever must the property; which I have in my will, signed & sealed by the testator, the aforesaid James Gaulton, and witnessed by Messrs Jesse Thornton and Thomas Bradley, at Burin on the eighth day of November, one Thousand eight hundred and seventy nine; bequeathed all right & title thereof to my daughter Martha Brushett, aforementioned, her heirs and assigns; and also to my Grandchildren, the aforesaid George Bradley Gaulton, John Albert Gaulton, Reuben Thomas Gaulton, James Howard Gaulton, and Charles William Gaulton, their heirs, and assigns; be sold, but to the person or persons hereinbefore mentioned. Given under my hand and seal this tenth day of August. In the year of Our Lord, One thousand eight hundred and eighty at Sagona in the District of Fortune Bay, Newfoundland. I further declare that this Codicil is attached to the former will aforesaid, in my presence Signed and sealed by James (LS) Gaulton In the presence of Jesse Thornton William Knowling witnesses.
