Description:
The Newfoundlander contained domestic news, court cases, legislative proceedings, poetry and prose, extensive foreign news, shipping and fishing news, public notices and advertisements. Although it had a lively correspondence column, the Newfoundlander refrained from editorial commentary on domestic politics until the 1840's. The Newfoundlander was Liberal and Catholic in its editorial policy and disagreed with the Public Ledger and later, the Express, on many issues. In 1843, it opposed the Colleges Bill which would set up separate denominational educational systems. The paper often expressed concern with the widespread poverty, especially in the outports. The paper was eager for the return of Representative Government and had little patience with the opponents of Responsible Government who it found to be "thoroughly English in their predilections and antipathies" (Apr. 8, 1848). Shea, who now controlled the paper, became a member of the Legislature in 1848 and, except for the period from 1869 to 1873, served until his death in 1913. Initially cautious about reciprocal free trade with the United States, by 1856 he felt it would be a remedy to many of the Colony's economic problems. The Newfoundlander was the chief opposition paper during the Hoyles administration but in 1865, Shea was appointed Financial Secretary in the Carter cabinet.

The Newfoundlander had by this time become the principal Confederate newspaper and, with its old rival, the Express, a major opponent of the Charles Fox Bennett administration. The Chronicle, felt to be Bennett's mouthpiece, was the main adversary until 1881 and, after that, the Evening Telegram. Shea became Colonial Secretary in the second Carter administration and enthusiastically supported the railway. The paper opposed the New Party and supported the Whiteway government until it ceased publication at the end of 1884.

Coroner's InquestA Coroner's inquest was held on Tuesday last, on the body of a man named MICHAEL CORMICK, who was found drowned in the King's Bridge River. The unfortunate deceased had been seen crossing the Bridge at 6 o'clock on the morning of that day, but is supposed to have accidently slipped from the bank and been carried down the stream owing to the swollen state of the River. Verdict - Found drowned.

WeatherWe believe the oldest inhabitants have no recollection of such a continuance of mild open weather, in any corresponding season, as that with which we have been favoured since Christmas Day. - The Plough is in active operation in the Country, and we are even told that seeds are Springing up in some of the gardens in the vicinity of the town. Vessels approach the coast without difficulty, and discharging and loading proceed with as great difficulty as in the months of August or September.

DiedAt Fredericton, in New Brunswick, in the early part of last month, after several years of suffering, which she bore with the most pious resignation and Christian fortitude, Mrs. HESTER M'CAWLEY, a native of this town, daughter of the late Mr. CHARLES DENNING, relict of the late DANIEL M' CAWLEY, and mother of the Rev. Dr. George M'Cawley, President of King's College, Windsor, Nova Scotia. She was left, more than thirty years since, a very young widow, with two children, and her whole attention was directed to their education and improvement. She was often heard to say that her highest object of worldly ambition was to see her son a worthy minister of the Protestant Episcopal Church of which she was a member and in this wish she was gratified.

Coroner's InquestA Coroner's inquest was held on Thursday morning last, on the body of Mr. WILLIAM PICKER, who, about 8 o'clock on the preceding evening, accidently fell over the wharf of Messrs. Robinson, Brooking, Garland & Co. and was unfortunately drowned. A verdict to that effect was accordingly returned. He had held the office of storekeeper to the House of Messrs. Robinson, Brooking, Garland & Co. for some years.

Coroner's Inquest An inquest was held on Saturday last, (and adjourned to yesterday) before A.Hogsett, Esq., Coroner, on the body of THOMAS OATES, fisherman of this town, who, it appeared, came to his death in consequence of wounds received during a quarrel in the street on the night of Thursday last. After the examination of witnesses had been gone through, a verdict of willful murder was found by the Jury against JOHN MURPHY of St. John's, laborer, and JAMES DEVEREUX, also of St. John's, mariner - upon which charge the said parties ere committed by the Coroner to take their trial at the next term of the Supreme Court. - (Gazette of Tuesday).

Coroner's InquestOn Monday last an Inquest was held on a view of the body of MARGARET WALSH, who was inhumanly butchered on the previous morning by a man named BYRNE. It appeared by the evidence that the unfortunate woman was employed in milking her goat, when BYRNE rushed upon her and inflicted several severe cuts with a clasp knife, of which she died in the course of the same day. The Jury returned an unqualified verdict of willful murder against BYRNE, who is imprisoned to stand his trial in the fall term of the Supreme Court. - The man is said to have been subject to occasional fits of derangement.

Coroner's InquestOn the afternoon of the same day, an Inquest was held on the body of Mr. CHAS. NEWHOOK, Sr. of Trinity, who came by his death in consequence of having fallen on the deck of a vessel lying at the South Side, from a height of 4 or 5 feet, which occasioned concussion of the brain - a verdict was returned accordingly. - Mr. NEWHOOK was a most respectable man and has been a Shipbuilder in the employ of Messrs. Garland & Co. of Trinity, for 30 years - his loss is much regretted, by his employers and by all to whom he was known.

CourtThe trial of the two men MURPHY and DEVEREAUX, (who have been for some months imprisoned, and against whom true bills were found by the Grand Jury) suspected of the murder of THOMAS OATES in May last, came on in the Supreme Court on Tuesday last, and occupied the whole of the day. - The evidence was insufficient to substantiate the charge against the prisoners - and the Jury after a few minutes deliberation, found a verdict of NOT GUILTY.

It can hardly be necessary to premise that verdicts have been returned in accordance with the facts found. - Nov. 12 - Inquest on view of the body of MICHAEL DELANEY, a seaman, who died suddenly on the wharf of Baine, Johnson & Co. Nov. 20 - On view of the body of JOHN RYAN, fisherman, found dead on the road on the north side of Quidi Vidi Pond. Nov. 23 - On view of the body of JAS. BROCK, who died suddenly on board the Brig Narcissus, lying at the wharf of Robinson, Brooking, Farland & Co. Nov. 23 - On view of the body of THOMAS HARTERY (an idiot) found dead in the morning, at the forge of John Power, Magotty Cove, Blacksmith. Nov. 30 - On view of the body of HENRY SHEA, late a seaman on board the schooner Dolphin, of Brigus - found drowned. - Same day
on view of the body of JAMES BAKER, master of the brig Columbia, consigned to Job Brothers & Co. of this place. Mr. BAKER had been in the habit of occasionally sleeping on shore, in the house of a respectable family, and previously to his retiring to rest, which was very early on the preceding evening, he complained of some little fatigue, and requested the lady of the house to look into his room before she retired for the night, which she kindly did, aware, we believe, that he had been accustomed to some sudden attacks. She found him awake, and in answer to an inquiry he said that he felt better. On entering the room in the morning, he was found a corpse, having no doubt died in an apoplectic fit, which was, in fact, the verdict of the Jury. His remains were respectably attended to the grave yesterday. Capt. BAKER was a native of Ringmore, in Devonshire, was about 48 years of age. Dec. 2 - On view of the body of JANE BRAND, of the South side, who in a disordered state of mind had left her home on Sunday morning, and had gone into the woods, where on the following day she was found drowned in a pool of water. - Verdict, accidental drowning. - Ledger Dec. 3 - On view of the body of MICHAEL SHEEHAN, (found drowned) the following verdict was recorded: - "Accidental drowning, by falling overboard out of the schooner Nancy in the harbour of St. John's." - Same day

CasualtyWe regret to learn, that yesterday morning, as Mr. ROBERT PACK, second son of ROBERT PACK, Esq., was fowling on the Barrens between Carbonear and Trinity Bay, in company with Mr. Bethune of H. M. Customs, and while resting for a short time (having been in during the previous night) upon observing so the birds. He briefly drew his gun towards him by the nozzle, when a twig caught the trigger end and it suddenly went off: the contents entered his arm above the wrist, lacerating the blood vessels and muscles along the extent of the arm and laying bare the bone above the elbow. Mr. Bethune quickly repaired to Carbonear for assistance and a suitable vehicle was speedily sent in and conveyed Mr. PACK to his father's residence. Upon surgical aid being obtained it was found necessary to amputate the arm at the shoulder joint.This painful operation was performed by Dr. Dow, of this town, assisted by Dr. Walsh, of Carbonear, and Dr. Allen of Brigus, and borne by the unfortunate young gentleman with much firmness and fortitude. DiedAt the Incorporated College of Chambly, Lower Canada, the REV. RICHARD MACKAY, in the month of October 1838. Mr. MACKAY, having been many years resident at Harbor Grace, and also in St. John's. He was cutoff in the 29th year of his age by brain fever, the violence of which, with a vigorous constitution, he was able to resist only two days and died in the esteem and affection of his fellow students and brother professors. The Rev. Mr. MACKAY was only a few months in Holy Order, but had for a considerable time filled the chair of the Professorship of the English language in that college.

BoatwreckMelancholy Boatwreck and Loss of Life - We regret to state that on the night of Wednesday last, a boat (that would carry about 100 qtls. round fish) belonging to Mr. ROBERT ANDREWS, of Port-de-Grave, and bound hence for that place with supplies, was totally lost, having struck on the Biscayan rock near Cape St. Francis, and shortly after gone down. There were seven persons in the boat, four of whom succeeded in getting upon the rock, leaving the son of Mr. ANDREWS, his daughter (a girl of 12 or 13 years of age) and one of the crew on board. Sail was then made upon the boat, but she had not proceeded far when she was seen to founder, and the cries of the unhappy sufferers were distinctly heard by the surviving parties. It was a moonlight night, and there being only a moderate breeze, the accident is likely to have arisen from the man at the helm not having kept a sufficient look-out, or more probably having fallen asleep. However it happened, it is a melancholy disaster, and should operate as a warning to others of the necessity of precaution and vigilance upon occasions where we apprehend too much confidence, if not, carelessness, commonly prevails.

DeathAfflicting Circumstances - Messrs. JOHN and THOMAS EDENS, two respectable young men of this town, started on Monday afternoon last for Trepassey. On that day they arrived at Bay Bulls and having rested for the night, on the next morning proceeded on their journey. About mid-way, however, they were overtaken by the late violent storm and THOMAS, the younger of the two, became exhausted and eventually unable to proceed. Finding his brother in this most dreadful situation and all but worn out himself, Mr. JOHN EDENS endeavoured to find his way to Toad's Cove: from his distracted state of mind, however, he lost his road, and did not arrive till 4 o'clock on the following morning, after wandering about for nearly ten hours of inclement weather. When he succeeded in making his sad tale known, the kind hearted people of Toad's Cove, in a body, instantly proceeded to the assistance of the unfortunate young man; but alas! As was anticipated, too late for succour! The body was found and conveyed to Toad's Cove - and from thence here. Mr. JOHN EDENS lies in a dangerous state at Bay Bulls. The funeral of the deceased Mr. THOMAS EDENS took place on Monday
and was attended by the members of the Newfoundland Natives Society, and a large number of other persons.

DeathMelancholy Accident - We regret to learn that on Saturday last, Mr. JOHN NORMAN, sen., of Brigus, met with a severe accident whilst gunning at Long Pond, about four miles from his residence. The twig of a bush accidently caught the hammer of the gunlock while he was in the act of passing a rivulet, and the gun exploding, lodger the whole of its contents in his right foot. Some persons who were within hearing conveyed the unfortunate man, who is in the 75th year of his age, to his home; where the foot was found to have been so much shattered as to render amputation below the knee necessary, and this was accordingly performed by Messrs. Surgeons Allen and Dow. - Ledger

InquestOn the morning of Sunday last, an inquest was held at the Military Hospital, before Aaron Hogsett, Esq., and a Coroner's Jury, on view of the body of EDWARD FITZGERALD, late a Corporal in the Royal Veteran Companies who died in a fit of apoplexy at Signal Hill about 9 o'clock on the preceding evening. A post mortem examination of the body was held by Drs. Pink and Sall, the medical men of the corps, who deposed that the deceased had died from the cause above stated, and the jury returned a verdict accordingly.

LossMelancholy Occurrence - We regret to learn by letters from Placentia Bay, that two Western boats, which left this late in October, bound for Beau Bois, have not since been accounted for. They were owned by respectable, industrious planters, named THOMAS and DANIEL FARRELL, who with two or three married sons, and four or five other persons - nine in all - were returning home with their winter supplies. Their loss will be much felt in the little community of which they were respected members, but most particularly by their families, who, by this visitation of Providence, have been reduced from independence to a state of extreme destitution.

Shocking AccidentOn Saturday morning last between the hours of 6 and 7, a house belonging to a person named WILLIAM CALLAHAN at Bay Robert's (south ridge) took fire from a pitch pot which had been incautiously placed upon the heart to boil, and in a few minutes the whole edifice was wrapped in flames. The family with great difficulty effected their escape, with the exception of a girl aged 12 or 13 years, who was sleeping above stairs, and who in the confusion was neglected till all efforts to rescue her proved utterly fruitless. Her remains were afterwards discovered among the ruins of the building. CALLAHAN himself was severely burned.

Coroner's InquestOn Tuesday evening last, about half-past 4 o'clock, an inquest was held before Aaron Hogsett, Esq., and a Coroner's Jury, on the body of JOHN MITCHELL, a respectable farmer in the neighbourhood of St. John 's. It appeared upon the evidence of the servant, JOHANNA WALSH, that she went out into the stable yeard, wither her master, a little after 2 o'clock, and upon coming out he fell down, and never spoke afterwards. - Dr. Carson was sent for, but that gentleman was of opinion that his presence could have been of no use, as death must have ensured almost immediately. Verdict of the Jury - "Died by the Visitation of God in a fit of apoplexy."

Coroner's InquestOn Thursday afternoon, the 5th instant, at Fresh Water, before Aaron Hogsett, Esq., and a Coroner's Jury, upon the body of JAMES DAY, about 20 years of age, lately a resident at Fresh Water, aforesaid - it appeared from the evidence of JOHN SUPPLE, that on the same afternoon a number of men (deceased being one of the number) had left their vessel to come on shore for molasses and some things left behind, and when returning to their vessel, the deceased, instead of keeping like others, by the old ice, took to the new to make a short cut, and unfortunately fell through; and before any assistance could be rendered, life became extinct. No quarrelling or angry words had passed between deceased or any person on the ice. Witness is sure that he came to his death by accidentally falling through the ice. - Verdict accordingly.

CasualtyIn the list of casualities in the recent engagement of our armies in the East, we observe the name of Lieut. ROBERT LAW, Her Majesty's 31st Foot, mentioned among the "severely wounded" in the last terrible battle of Sobraon, on the 10th February. This young gentleman is the eldest son of Lieut Col. LAW, commanding Royal Newfoundland Companies, and one whom we remember to have been a mere boy by his father's side, a few years ago. He has already at the age of three and twenty earned very distinguished laurels, having fought in the four tremendous conflicts with the Sikhs, and born the evidence of severe wounds to attest his valour, in the last and most fearful struggle. We sincerely trust that the next intelligence will be such as to relieve the anxious apprehensions his friends must naturally feel under the present circumstances, though with their fears may well be mingled a sensation of no ordinary pride at the honors so early won, of their young and gallant relative.

DeathsBy Drowning - A very melancholy circumstance occurred near Quidi Vidi on the morning of Thursday last. It appears that a Picnic party were spending the day in the neighborhood of the lake, and that soon after landing two of the number (Mr. HENRY WINSOR and his brother) took a boat to the fishing ground for an hour's amusement. They had passed but a short time there, however, when the boat was suddenly capsized by a squall and the unhappy men launched into eternity. To add to the calamity, Mr. H. WINSOR, has left a wife and small family to lament the sad fate of a husband and father.

Coroner's InquestOn Saturday evening last, before Aaron Hogsett, Esq, and a Coroner's Jury, upon view of the body of MICHAEL MORRISSEY, of St. John's, fisherman. It appeared by the evidence of Doctors Renouf, Kielley, Shea and Martin, who had all attended the deceased before his death & almost immediately after two or three wounds had been inflicted upon him by a person named TIMOTHY RYAN, with a hatchet, that they were of such a nature as to cause death, particularly that on the right side of the head which fractured the scull - and which fracture appeared to be produced by the blow of a blunt and heavy instrument, such as the pole of a hatchet. The other wounds appeared to be inflicted with a sharp instrument - most likely with the edge of the hatchet made use of. The whole evidence before the Jury being so clear as to the malice and deliberation of the ACT, they did not long hesitate in finding a verdict of "Wilful Murder" against TIMOTHY RYAN - who was committed for trial accordingly.

DeathAmongst the catastrophes of the gale of the 19th ult., we regret to have to record the premature death of Mr. THOMAS MAYNE, of Bonne Bay. The deceased with one or two others left home in an open boat not long before the gale sprung up, and was not afterwards heard of until the morning of the 23rd, when the boat containing their remains was found ashore at Cow Harbor. Mr. MAYNE was but recently married and he left a young and afflicted widow to mourn.

Coroner's InquestAt an early hour yesterday morning before Aaron Hogsett, Esq., and a Coroner's Jury on the wharf of Messrs. Baine, Johnston & Co., merchants, upon view of the body of JOHN MURPHY, late of Placentia, fisherman. It appeared upon the evidence of JOHN SAMPSON, that the deceased and himself had been drinking on shore, but very little. - That a little after gun-fire, witness went into the fore-cuddy of the boat laying at the head of the wharf of Messrs. Baine, Johnston & Co. The deceased accompanied him with a candle, a lanthorn to his bed in the fore-cuddy, then went oaft to the after-cuddy, believes, to bed. Witness was called sometime in the night when the afterpart of the boat was all on fire. There was only fish in the after cabin. The deceased MURPHY was in the habit of sticking lighted candles against the boards of the cuddy. (The Coroner remarked he would make the most public use of this as a warning not only for the observation of life; but as two fine vessels at the same wharf, as well as the premises, and many other habitations besides might have been consumed.) PATRICK KOUGH, late of Bonavista Bay, sworn - he saw the fire first in the morning when turning through the narrows. Has no doubt that the fire was caused by negligence and that the deceased came to his death in consequence. Verdict of Jury accordingly.

The deceased was Principal and Managing Partner for some years, of the highly respectable firm of Messrs.
