THREE DAYS after the date hereof, application will be made to the Honourable the Supreme Court, or one of the Honourable the Judges thereof, for Letters of Probate to the last will and testament of William Vokey, sr., late of Spaniards Bay, Fisherman, deceased. to be granted to Benjamin B. Squires, of Spaniards Bay aforesaid, Merchant, one of the executors named in the said will.

To the Honourable the Supreme Court or one of the Honourable the Judges thereof: -

The petition of Benjamin B. Squires, of Spaniards Bay, Merchant, humbly sets forth as follows:-

    1. William Vokey, sr., late of Spaniards Bay, Fisherman, died at that place in the month of October, A.D. 1899, having first executed his last will and testament, which said last will and testament, proven upon my oath, is hereto annexed marked "A".
    2. Since the death of the said deceased the said will was in the custody of his widow up to a short time before her death, when it was handed over by her to James Vokey, one of the beneficiaries in the said will. Since that date the will has been continuously in the custody of the said James Vokey, until it was produced for proof.
    3. At the time of his death the said deceased left him surviving as sole next of kin his widow, Jane Vokey, who has since died, and four children, namely, James Vokey, Israel Vokey, Mary Brown, at present resident in Boston, in the State of Massachusetts, in the United States of America, and Elizabeth Reid, at present resident in Dildo, in the electoral district of Trinity.
    4. At the date of his death the said deceased was possessed of property within the jurisdiction of this Honourable Court of a value not exceeding the sum of $400.00, as will more fully appear by reference to the inventory hereto annexed marked "B", which is to be taken as a part hereof.
    5. Under the said will the said testator appointed your petitioner and Solomon Gosse, sr., both of Spaniards Bay, to be the executors thereof. The said Solomon Gosse, sr., died at Spaniards Bay aforesaid in the fall spring of the year 1911, intestate, leaving your petitioner as sole surviving executor.
    6. No letters of probate to any last will nor letters of administration to the estate and effects of the said deceased have yet been granted to any person.

Your petitioner therefore prays that letters of probate to the last will and testament of the said deceased may be granted to him: And as in duty bound he will ever pray.

    1. I am the petitioner in the petition hereto annexed for letters of probate to the last will and testament of William Vokey, sr., late of Spaniards Bay, Fisherman, deceased.
    2. The several matters and things therein contained, together with the inventory thereto annexed marked "B", are just, correct and true to the best of my knowledge and belief.

This is the last Will and Testament of me William Vokey.

 

I William Vokey Sr. fisherman of Spaniards Bay Newfoundland being in a Sound State of mind. do make and ordain this my last Will and Testament and in so doing I first nominate, constitute, and appoint B.B. Squires and Solomon Gosse Sr. of Spaniards Bay to be the Sole Executors of this my last Will & Testament. After which I give and bequeath of my property in the manner and proportions here following:-

First, I give and bequeath to my Son James his heirs, assigns, and [illegible] my dwelling house, and all my front land situated at Bunker’s Hill Spaniards Bay, to become his only after the death of my wife Jane should she not depart this life before me. And secondly I give and bequeath to my three grandsons ay George, Henry, and James Vokey of Henry All my back land situate at Bunker’s Hill Spaniards Bay. to become theirs only after the death of my wife Jane should she not depart this life before me.

And I the said William Vokey aforesaid do hereby revoke all the Wills and Testaments by me at any time heretofore made I do hereby declare this to be my last Will and Testament.

In Witness whereof I the said William Vokey have to this my last Will and Testament Set my hand this 15th day of September Anno Domini One thousand Eight hundred and ninety two.

One Thousand Eight hundred and ninety two, I was present and did see William Vokey, late of Spaniards Bay, in the Electoral District of Harbor Grace, in the Island aforesaid, Fisherman, the Testator named in the paper writing hereunto annexed, marked A., duly sign, publish and declare the said annexed paper writing, as and for his last Will and Testament in my presence, and in the presence of Solomon Gosse Sr. the other subscribing witness thereto. That I and said Solomon Gosse Sr. then and there signed our names to such Will as such witnesses, in the presence of the said Testator. And that at the time of the said execution of the said Will the said Testator was of sound and disposing mind, memory, and understanding, to the best of my knowledge and belief.

That previously to the said Will being so signed, as aforesaid, by the said Testator and the said witnesses, it was read over to, and approved of by, the said Testator in the presence of me and the said Solomon Gosse, Sr. and that at the time of the said execution of the said Will, the said Testator was of sound and disposing mind, memory, and understanding, to the best of my knowledge and belief.

In the Supreme Court of Newfoundland

In the Estate of William Vokey, late of Spaniards Bay, Fisherman Deceased.

I Benjamin B. Squires of Spaniards Bay, in the Electoral District of Harbor Graced, make oath and say that William Vokey late of Spaniards Bay, in the Electoral District of Harbor Grace Fisherman deceased, died with a Will, that I am one of the executors therein named; that I will well and faithfully administer the Estate and Effects of the Testator by paying his just debts and the Legacies contained in his Will so far as the same shall thereto extend and the Law bind me, and by distributing the residue (if any) of the said Estate and Effects according to Law; that I will exhibit under oath a true, full and perfect Inventory of all and singular the Estate and Effects of the Testator, and render a just and true account thereof whenever required by Law so to do; that the Testator died at Spaniards Bay aforesaid on the - day of October, One Thousand Eight Hundred and ninety nine; and that the gross value of the Estate and Effects of the said Testator is four hundred Dollars, and no more, according to the best of my knowledge, information and belief.
