In re WILLIAM HUDSON PENNEY: DECEASED. This is the last will and testament of me William Hudson Penney of Carbonear Conception Bay in the Island of Newfoundland made this second day of March in the year of our Lord one thousand eight hundred and sixty-nine I hereby revoke all wills by me at any time heretofore made. I appoint Benjamin T.H. Gould and John Fletcher Apsey both of Carbonear to be my executors and direct that all my just debts and funeral and testamentary expenses shall be paid as soon as conveniently may be after my decease.I give and bequeath unto my three sons Edgar Penney, Josiah Henry Penney and Alfred Penney thirty two shares in the schooner "Emeline" also the whole or sixty four shares of the Schooner "Aurora", also my fishing establishment at Red Bay Labrador, consisting of house stores seines boats and all other property appertaining thereto to be held by them equally And it is my wish that my son Edgar Penney be the Manager of the business connected therewith And I also give and bequeath unto my son Josiah Henry Penn ey the western half of new dwelling house with half the store half the cellar and half the land in the rear thereof. And I give and bequeath to my son Alfred Penny the dwelling house that I now occupy and the outhouses together with the garden and all the land in the rear thereof with this condition that my beloved wife Mary Penny until her decease or marriage shall occupy and have full control of the same and that my son Josiah Henry Penny and my daughters Louisa Sophia and Elizabeth Penny shall reside therein until their marriage and that my son William Frederick Penny shall have a home therein (said dwelling house) unt il he is twenty one years of age should he desire or need it. And I give and bequeath to my beloved wife Mary Penny all my household furniture. And I give and bequeath of my monies now deposited in the Union Bank St. John's to my beloved wife Mary Penny the sum of twelve hundred dollars And to my three sons Edgar, Josiah Henry and Alfred Penny each the sum of six hundred dollars And to my son William Frederick Penny the sum of four hundred dollars And to my two daughters Louisa Sophia and Elizabeth Penny each the sum of two hundred dollars And to my daughter Grac e Powell the sum of forty dollars. Now the conditions of the above bequest are that my three sons Edgar, Josiah Henry and Alfred Penny shall respectably and comfortably support and maintain my beloved wife Mary Penny until her marriage or decease and shall respectably and comfortably support and maintain my two daughters Louisa Sophia and Elizabeth Penny until their marriage or decease And that my son William Frederick Penny be also provided for until he is twenty-one years of age- and that the schooner "Aurora" shall be rebuilt at the expen se of my estate and when rebuilt shall still remain the property of my three sons Edgar, Josiah Henry and Alfred Penny conjointly. And that all my other monies, goods and effects remaining after the appropriation of the aforesaid bequests and the rebuilding of the schooner "Aurora" (that is to say other monies goods and effects not before mentioned herein) shall be equally divided between my three sons Edgar, Josiah Henry and Alfred Penny- William Hudson his X mark Penny (LS) Signed by the said William Hudson Penny the testator in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witness, Witness B.
