In re
WILLIAM COOK deceased.
This is the last will and testament of me William Cook of Saint John’s
in the Island of Newfoundland Butcher. 1. I appoint my sons Tasker Cook
and James Cook executors of this my will. 2. I give to my executors
power to realize any investments which I may have at present or to continue such investments;
to invest any monies of my estate upon the security of landed property in or near Saint John’s
and to vary such investments from time to time 3. I direct that the income of my estate
shall be paid to my wife Anna Cook during her life. 4. On the death of
my said wife I give devise and bequeath my property estate and effects as follows:-
- (1) To my said son Tasker my lands and premises situate on Hagerty Street and Pleasant
Street in Saint John’s.
- (2) To my daughter Ella Worsley wife of Nicholas Worsley of
Saint John’s my lands and premises situate on the corner of New Gower Street and Springdale
Street in Saint John’s
- (3) To my said son James my lands and premises situate on the
corner of Duckworth Street and King’s Road in Saint John’s.
- (4) To my son William the
land and house situate on Water Street in Saint John’s at present occupied by Miss O’Brien
together with the land in the rear thereof running back to Duckworth Street and the piece of
land adjoining.
- (5) To my grandson Ralph Kennedy one undivided third share of my
lands and premises situate on Cook Street; Freshwater Road; Scott Street; Merrymeeting Road
and Gower Street East.
- (6) To my daughter Mina Cake wife of George Cake of Saint
John’s one undivided third share of my said lands and premises situate on Cook Street;
Freshwater Road; Scott Street; Merrymeeting Road and Gower Street East during her life. Should
she leave issue her surviving the said one undivided third share shall on her death go to such
issue; but if she shall not leave issue her surviving then such undivided third share shall on
her death go to my said three sons and my said daughter Ella Worsley all sharing alike.
- (7) To my daughter Blanche Snow wife of George Snow of Saint John’s one undivided
third share of my said lands and premises situate on Cook Street; Freshwater Road; Scott
Street; Merrymeeting Road and Gower Street East during her life. Should she
leave issue her surviving the said one undivided third share shall on her death go to such
issue; but if she shall not leave issue her surviving then on her death such undivided third
share shall go to my said three sons and my said daughter Ella Worsley all sharing alike.
- (8) To the Church of England Orphanage in Saint John’s Five hundred dollars.
- (9) To the Methodist Orphanage in Saint John’s, Belvidere Orphanage in Saint John’s
and Mount Cashel Industrial School to be equally divided between them the sum of five hundred
dollars.
- (10) To the Rector and Church Wardens of St. Mary’s Church, Saint John’s for
the use of the said Church, Five hundred dollars.
- (11) To my grandson William Cook
(son of the said Tasker Cook) the sum of five hundred dollars.
- (12) To the Masonic
Benevolent Fund and the Tasker Educational Fund the income of the proceeds of my Masonic
Insurance; The said Insurance to be invested by my executors and the income
to be paid by them to the said two Funds in equal shares.
5. I
give devise and bequeath all the residue of my estate to all my said children and my grandson
Ralph Kennedy in equal shares the said Ralph Kennedy sharing as one of my children).
Provided and I will and direct that the shares of the said Mina Cake and
Blanche Snow shall be subject to the same limitations terms and conditions as apply to the
foregoing bequests to them viz:- That they shall hold for their respective lives only;
Should they leave issue them surviving their shares shall go to their
respective children and should they or either of them die without leaving issue their or her
surviving their or her shares or share shall go to my said three sons and my said daughter
Ella Worsley all sharing alike. 6. I hereby revoke all former wills
made by me. Witness my hand at Saint Johns’ aforesaid this twenty first day
of October Anno Domini one thousand nine hundred and fifteen. William Cook.

and testament in the presence of us who at his request in his presence and in the presence of
each other (all present at the same time) have hereunto subscribed our names as witnesses W.
