THIS INDENTURE made, entered and concluded upon in Harbour Grace the seventh day of September in the forty-seventh year of the reign of our Sovereign, Lord George the 3rd, by the Grace of God of the United Kingdom of Great Britain and Ireland, King, Defender of the Faith and so forth, and in the year of our Lord God one thousand, eight hundred and seven, between John Warford of Mint Cove, in Spaniard’s Bay, in Conception Bay, in the Island of Newfoundland, Planter and Boatkeeper, of the One Part, and Michael Farrell, Cooper and Resident of said place of the Second Part. Witness forth by these presents that the said John Warford, for and in consideration of the full sum of One Hundred pounds of lawful money of Great Britain to be paid him in manner and form following and as is hereafter mentioned, have bargained, sold, transferred, assigned, and forever made over as by these presents for himself, his Heirs, Executors, Administrators, and Assigns do sell, bargain, assign, transfer, and forever make over unto him, the said Michael Farrell, his heirs and assigns, all his Fishing Room and Premises situate in Mint Cove in Spaniard’s Bay as aforesaid, consisting of a dwelling house, stage, flake, and two gardens, all other easements, waterways, pathways, and liberties thereunto belonging or in any wise appertaining dimensions and boundaries, as follows: Fifty-three yards from north to south, bounded on the south by the woods and on the north by Timothy Collins’ Room, two hundred yards from high watermark to the westward, bounded on the west by the woods, all cut and cleared agreeable to the Act of King William 3rd in the year 1795 as appears by the Records, which before mentioned Premises with all the appurtenances thereunto belonging. The said John Warford hath good right, full proven, and lawful and rightful authority in himself to sell, bargain, and transfer the same in manner and form as aforesaid, and the said Michael Farrell binds himself, his heirs and assigns, and for the better security the said premises unto him, the said John Warford, for the full sum of One Hundred Pounds Sterling being the consideration and full purchase money of the aforesaid premises—the first payment to be paid on the twentieth day of October next non-ensuing the sum of Ten pounds sterling—and on the last day of February next, 1808, the sum of Ten pounds sterling in oil casks to be delivered to Mr. Thomas Danson—and the sum of Twenty pounds sterling on the twentieth day of October in each year in succession till the aforesaid sum of One Hundred pounds be fully paid up by him, the said Michael Farrell, his heirs and assigns unto him, the said John Warford, his heirs and assigns, after which payments being duly performed the said John Warford warrants to defend him, the said Michael Farrell, against all lawful claims of him, the said John Warford, his heirs and assigns in their full peaceable possession in the aforesaid bargained premises and every part and parcel thereof for him, the said Michael Farrell, his heirs and successors freely and absolutely enjoy the same forever. IN WITNESS WHEREOF both parties interchangeably fix their hands and seals this seventh day of September in Harbour Grace as before written 1807. KNOW ALL MEN BY THESE PRESENTS that the Conditions of the annexed Bill of Sale is such that the said John Warford assigns, transfers and makes over the said annual sums mentioned thereon amounting to One Hundred pounds sterling to Mr. Mathew Kearney, Merchant of Harbour Grace, or his assigns in consequence of a Deed of Assignment made to Messrs. Thomey and Kearney, bearing date the 13th day of February, 1798, which appears on record of the said premises, and the said Michael Farrell doth agree and hereby bind himself, his heirs and assigns as also as well the aforesaid premises to pay unto Mathew Kearney the aforesaid annual sums so specified in the foregoing Bill of Sale agreeable to this assignment made by the said John Warford and in virtue of the aforesaid former assignment made to Thomey & Kearney in 1798 of the said premises.
