In re the Estate of

Solomon Penney, deceased.

This is the last will and testament of me Solomon Penney South side of Carbonear in the Island of Newfoundland. I devise and bequeath to my son John Martin Penney all my Labrador property to be his absolutely. I further bequeath to him a piece of land with a dwelling house thereon bounded on the north by a lane, on the south by James French, on the east by a lane and on the west by William Scott; also a piece of land known by the name of Footes garden; also the one half of a piece of land bounded on the north by the Knight’s Marsh Road, on the south by William Walsh, on the east by Hugh Robert Penney and on the west by Esau Butt; also the one half, being the western part, of a piece of land known as bog land. I further devise and bequeath to the said John Martin Penney the one half of my cellar and the sum of four hundred dollars.

I devise and bequeath to John White a piece of land bounded on the north by Powells Brook, on the south by the Main Road, on the east by George Penney and on the west by a cart road; also a piece of land, with a stable thereon, bounded on the north by Knight’s Marsh Road, on the south by Charles McCarthy, on the east by Solomon Penney and on the west by a cart road.

I devise and bequeath to my wife Honora Penney a piece of land, with a small shore and a cellar thereon, known as Wellmans(?) land, bounded on the north by Knight’s Marsh Road, on the south by Mark Forward, on the east by John Pike and on the west by Solomon Penney; also a piece of land with my dwelling house and out houses thereon, bounded on the north by Powells Brook, on the south by Knights Marsh road, on the east by Charles McCarthy and on the west by Nathaniel Penney; also one half of a piece of land bounded on the north by Knights Marsh Road, on the south by William Walsh, on the east by Hugh Robert Penney and on the west by Esau Butt. I further devise and bequeath to my wife Honora Penney all my furniture including every article belonging to and in my dwelling house, also all my live stock, utensils for farm and stable use and a sum of money amounting to four hundred dollars.

I devise and bequeath, after my wifes decease, to Sarah Susanna White my dwelling house and out houses attached thereto and also the piece of land immediately connected therewith; and I appoint Robert Fraize sole executor of this will, hereby revoking all former and other wills, codicils or testamentary writings heretofore by me at any time made

In witness whereof I the testator have set my mark this fifth day of December in the year of our Lord one thousand nine hundred and four.

Signed and declared by the testator as and for his last will and testament in the presence of us, who in his presence, at his request and in the presence of each other have subscribed our names as witnesses

Robert Fraize George A Moulton.

Codicil with regard to the piece of land the one half of which is bequeathed to my son John Martin Penney bounded on the north by the knight’s Marsh road, on the south by William Walsh, on the east by Hugh Robert Penney and on the west by Esau Butt, the said John Martin Penney is not to take possession of that part which is meadow land until the expiration of five years after my decease. I further devise and bequeath to John White the one half of a piece of land, being the eastern part, known as bog land. In witness whereof I the Testator do set my mark this 5th day of December in the year of our Lord one thousand nine hundred and four
