This Indenture, indented made and concluded on this twenty-first day of December in the fifty- ninth year of the Reign of our Sovereign Lord George the third, by the Grace of God of the United Kingdom of Great Britain & Ireland, King, Defender of the Faith and so forth – and in the year of our Lord one thousand eight hundred and eighteen. Between Roger Butt & Sons (Charles, Moses & Aaron) in the District of Conception Bay and Island of Newfoundland, Planters of the one part, and George Kemp, Jas Kemp, Martin Kemp Welch and George Kemp the Younger, of the Town and County of Poole, Merchants and Copartners on the other part – Whereas the said Roger Butt & Sons at sundry times heretofore has had dealings with them, the said George Kemp, James Kemp, Martin Kemp Welch and George Kemp the Younger or their Factor or Agent for the time being at …. (first line of second page cut off when photocopied) ….. considerable amount and thereby contracted a Debt with them, amounting in value to the sum of three hundred and nine pounds – which Debt they, the said Roger Butt & Sons are at present unable to pay off or discharge – Now this Indenture witnesseth that the said Roger Butt & Sons for and in consideration of the aforesaid sum of three hundred & nine pounds to them paid and advanced in manner aforesaid, the receipt whereof the said Roger Butt & Sons doth hereby acknowledge and themselves to be therewith fully and perfectly satisfied, hath granted, bargained, sold, assigned, transferred & set over, and by these presents doth Grant, Bargain, Sell, assign, Transfer and set over unto them the said George Kemp, James Kemp, Martin Kemp Welch and George Kemp the Younger, all that Room or Plantation situated in Fresh Water and now in the occupancy and possession of the said Roger Butt & Sons being bounded to the East by Wm Davis’s Room, to the West by John & William Moores’ Room, to the North by Thomas & Charles Parsons’ Room, & to the South by the Sea, and all and singular the dwelling house, out house with all other Buildings and Erections together with all the Meadows, Gardens, Stages, Flakes, Fences, Enclosures, Ways, paths, Passages, Rents, Issues, Profits, Commodities, Priviledges, and Appurtenances whatsoever thereunto belonging or appertaining – To have and to hold the said Fishing Room or Plantation with all and Singular the Dwelling House, Out Houses, Buildings Gardens, Erections, Meadows, with the appurtenances thereunto belonging or appertaining unto them the said George Kemp, James Kemp, Martin Kemp Welch and George Kemp the Younger their Heirs, Executors, Administrators and Assigns, forever, and the said Roger Butt Sons doth hereby for themselves, their heirs, Executors and administrators, covenant, promise and agree to and with the same George Kemp, James Kemp, Martin Kemp Welch and George Kemp…… (last photocopied page missing) Transcribed by Susan Snelgrove, Etobicoke, ON on Oct 23, 1999 Transcriber’s Note: Punctuation has been added to aid in reading this document.
