Will of Richard Newell

In re     Richard Newell     deceased.

    This is the last will and Testament of me Richard Newell (of sound mind) of the Dock, Bareneed, Conception Bay, Newfoundland     I hereby give devise and bequeath, to Nathan Newell my nephew, who has lived with me upwards of 9 years, his heirs executors & administrators for his, and their own use and benefit, absolutely and for ever all my estate, and effects (except a deposit in my name at the Branch of the Government Saving’s Bank Harbour Grace): both real and personal, whatever and wheresoever, and of what nature and quality soever. Should I die in the year 1908 A.D. each of my brothers Nathaniel and Philip now living at the Dock is to get $50.00 of the aforesaid Deposit, at the Government Savings Bank Harbour Grace: but should I live until the year 1909 A.D. the amount falling to each of my aforesaid brothers, shall amount to $40.00 of the Balance lying in my name at the aforesaid Bank, but should either or both of them die (each or both of them) forfeits their claim to the aforesaid amount, and in case of them predeceasing me, my nephew Nathan can dispose of the aforesaid Balances at his will and shall as for the money (or Balance) goes, supply his father’s needs at his own discretion Moreover the Benefit accruing from the Orange Lodge is to be expended in order to defray my burial expenses, the whole to be left to the management of my nephew Nathan Newell whom I make sole executor of my will. In witness whereof I have hereunto set my hand this 27th day of January 1908 (sgd) Richard his X mark Newell Signed by the said Richard Newell in the presence of us, present at the same time, who, in his presence and in the presence of each other, attest and subscribe our names as witnesses thereto this 27th day of January 1908 (sgd) Jacob Bishop (sgd) William his x mark Sealey
