In re: RICHARD DUNNE. DECEASED.
This is the last will and testament of me Richard Dunne, of Bread Cove in the
Electoral District of Bay De Verde. Physician.
I revoke all former wills by me
at any time made and I appoint my nephew Michael Stapleton of Harbour Grace
Executor of this my will.
I give, devise and bequeath to my said Executor my
homestead property at Bread Cove aforesaid being the land purchased by me from Levi
Garland [about thirty five acres] and Noah Thistle's [between five and six
acres] upon trust to permit my wife Mary Dunn to use and enjoy the same during her
life and upon her death then upon trust to divide the same between my four sons
Richard, Timothy, Patrick and Ronald in manner hereinafter specified, provided
that if any of my sons shall at my wife's death be residing upon said property
he or they shall be entitled whilst so resident to use and enjoy the portion
hereinafter allotted to his or their brothers or brother not so resident until
the latter shall return and take up residence upon such portion or shall sell the
same:
And it is my will and desire that if any of my sons desires to sell his
portion of the said property he shall give the first refusal thereof to his
brothers. The following is the division hereinafter referred to, namely: My son
Ronald is to have the portion of my said property upon which my house and barn
are erected, extending Northerly to the Railroad track and bounded to the
Westward by my private road; my son Patrick the portion in the rear thereof extending
from the railway track to the rear of the rear of the property, bounded on the
Westward by my said private road and Eastward by the break; my son Timothy the
land bought from Thistle and land in the rear thereof, extending to the woods
Road north of and parallel to said railway track; and my son Richard the portion
in rear thereof, bounded Southward the said Woods Road, Eastward by said
private road and extending to the rear of my said property.
I give devise and
bequeath to my said sons my property at Bread Cove aforesaid held by me under grant
from the Crown, dated March 2nd. 1908. [Volume 74. Folio 153] to be divided
equally between them. I give and bequeath to my said son Timothy my shares in
Columbus Hall Company, Limited of the par value of One Thousand Dollars; to each
of my sons Richard and Patrick out of of my shares in the United Towns
Electrical Company, Limited shares of the par value of One thousand dollars and to my
wife Mary the remaining Five Hundred Dollars of my holdings in the said last
named Company.
I give and bequeath to my daughter Cecilia Femoyer the sum of Two
Hundred Dollars; to my daughter Sarah Fahey the sum of Five Hundred Dollars; to
my daughter Bridget Dunn the sum of One Thousand dollars, and to my wife Mary
the sum of Five hundred dollars.
I direct my Executor to apply the sum of Three
thousand dollars or so much thereof as may be found necessary towards the
completion of the Medical education of my son Ronald, and to keeping in force his
policy in the Confederation Life Association, and to pay to my said son any
surplus of this legacy left after providing for such education and insurance. I
give and bequest to my said wife Mary my household furniture and personal effects,
my horses and cattle, carriages, carts, farm utensils and other like chattels,
and I request her to permit my children the reasonable use of the same, and to
dispose of the same at or before her death as she may consider most desirable
in the interests of my children and especially for the benefit of those who may
be residing on the property at the time of such disposition. All the rest
residue and remainder of my property and estate I give and bequeath to my four sons
in equal shares.
In witness whereof I have hereunto subscribed my hand at St. John's this
eighteenth day of August A.D. 1917. Richard Dunn. Signed published and declared by
the testator as and for his last will and testament in presence of us, both
being present at the same time, who in his presence and at his request hereunto
subscribe ourselves as witnesses attesting to the due execution thereof. Chas.

As I am very sick for the past few weeks and as I thought matters over very
carefully I ask you to cancel Michael Stapleton from been (?) Executive of my will.
I do hereby appoint my son Patrick Dunn in stead of Stapleton, to be the
Executive of my will, as I want to keep my family and my Business together. Please
