In re Richard Parmiter deceased. I Richard Parmiter now living with my son Samuel Parmiter of Otterbury Harbor Grace being of sound and disposing mind and memory do make and declare this to be my last will and testament I give devise and bequeath unto my son James John Parmiter all my right title and interest to and in my premises situate at Middle Bight South Shore Conception Bay with all buildings erections and improvements thereon and now in his possession, on trust, and I do hereby nominate, constitute and appoint my son James John to dispose of the aforesaid premises on the most satisfactory terms in his power, and to receive the purchase money for the same and his receipt will be their discharge and acquittal from all further claim on the premises. Should I be living when the aforesaid premises are sold my son James John is to remit the purchase money to me after paying himself for his trouble and what expense he may incur in the selling of the premises and receiving the money and for putting the purchaser or purchasers in possession in case of my predecease he is to remit the money to his brother Samuel with whom I am now living who is my sole executor And my son James John is to put the purchaser or purchasers in quiet and peaceable possession of what they purchased and paid for against the lawful let claim or hindrance of any person or persons whatsoever or wheresoever and I give him the sole right of disposing thereof. And at my decease whatever money I may have in Bank or whatever money I may have about my person or in the house I am living in After my just debts and funeral expenses are paid I give and dispose of in portions as hereinafter mentioned to be divided in seven parts as follows viz I give devise and bequeath unto my two eldest sons Samuel living at Otterbury Harbor Grace and James John living at Topsail their heirs and assigns three sevenths 3/7 of the whole amount each to have an equal part. I also give devise and bequeath unto the same Samuel and Jas. John my wearing apparel to be equally divided between them. I also do give devise and bequeath unto my son William living in Ha Ha Bay French Shore, unto my son Azarias living in Saint John’s and unto my daughter Matilda Hibbs living at Kelligrews their heirs and assigns one seventh 1/7 each and my daughter Matilda is to have and to hold her share independent of her husband and not subject to his debts liability or control and in case of the decease of my daughter Matilda Hibbs her share to be given to her stepbrother Jas. John on trust as guardian for her children and he is to give them her share according as they need it And I give devise and bequeath unto my two youngest daughters Elizabeth Jane Parmiter not married now living in Paris, France, and my daughter Belinda Crocker now living in Galtois Hermitage Bay one seventh of the whole the 1/7 to be equally divided between them. In case of the predecease of my daughter Elizabeth Jane her share is to be given to her sister Matilda Hibbs and in case of the predecease of my daughter Belinda her share is to be given to the orphan she has adopted My bed and bedstead my son Samuel can keep himself or give to any one of the aforesaid parties just as he thinks proper. The whole of the property I am owner of besides the foregoing is not worth mentioning and is to be left in the house I now live in. I do hereby nominate constitute and appoint my eldest son Samuel Parmiter to be my sole executor to this my last will and testament Witness our hands this nineteenth day of August in the year of our Lord one thousand eight hundred and eighty two Richard Parmiter, Thomas Parsons Senr, Thomas Parsons Junior.
