Vol. 5 Folio 446 In the Supreme Court. In re James Mosdell deceased. OATH OF EXECUTOR. Probate granted to James E. Mosdell one of the exec named in the will (the rights of the other exec being reserved) on the 6 day of January A.D. 1904 Value of Estate $200 710. (crossed 7) ----------------- (new page) mostly typed TO THE HONOURABLE THE SUPREME COURT OR ONE OF THE HONOURABLE THE JUDGES THEREOF.The Petition of James E. Mosdell and Willis L. Mosdell both of Bay Roberts aforesaid, Fisherman and Teacher respectively, Humbley sheweth That James Mosdell late of Bay Roberts aforesaid, Planter, died at that place in or about the 19th day of June A.D. 1903 having previously made and executed as and for his last Will and Testament the paper writing hereto annnexed marked "A", wherein he appointed your petitioners Executors thereof. The said James Mosdell deceased left him surviving as next of kin, his widow Ellen Mosdell, and two sons your petitioners, Jame Mosdell and Willis L. Mosdell Hereto annexed marked "A" is a schedule showing to the best of your Petitioner's knowledge information and belief an inventory of the property of the said James Mosdell at the time of his death. No Probate of any Will or administration of the estate of said deceased has been at any time granted by your Honourable Court. Your petitioners therefore pray that your Honourable Court or one of the Honourable the Judges thereof will be please to grant to them Letters of Porbate of the Will of said deceased. And as in duty bound your petitioners will over pray. Bay Roberts, December 19th A.D. 1903.

in the year of our Lord, one thousand
nine hundred and three make
this my last will and testament
as follows-
I will all that I may die
possessed of, land, houses, cattle,
and fishing ?, to my wife Ellen
Mosdell, for the period of her
natural life, or as long as she
remains unmarried, but with no
power to sell, or part with any portion of such land or property, unless
it be needful in the opinion of
I George Pepper of Bay Roberts aforesaid (Teacher) make oathe and say as follows. James Mosdell of Bay Roberts aforesaid the Grantor in the ?? here written Will named was personally known to me on the 16th day of June 1903. I was personally present and did see James Mosdell duly execute the said will of conveyance The signature James Mosdell his mark subscribed to the said will is in the proper mark of the said James Mosdell The signature George Pepper subscribed to the said will as that of the witness attesting >the due execution thesof is in my proper handwriting Sworn at Bay Robert aforesaid this 12th Day George Pepper (signed) Seal of December AD 1903 at 7.30 pm before me Geo Bursell Co(?).
