Will of Michael Walsh

IN RE:   MICHAEL WALSH.    DECEASED

In the name of God, Amen. I, Michael Walsh of Holyrood, Conception Bay in the Northern District of Newfoundland fisherman, being weak in body, and of sound mind memory and understanding, do make publish and declare this my last Will and Testament, in manner and form following, to wit:-

First: I give and bequeath unto my dear wife, Catherine Walsh, that piece of land situated at Holyrood and bounded as follows:- North by James Wall's land - South by Lawrence Barron's land - East by land belonging to the estate of James Walsh and West by George's Cove Mountain; also the dwelling house, Stable, and Cellar built thereon, during the term of her natural life. Upon her decease the said land, dwelling-house Stable and Cellar are the property of my son Daniel Walsh under the conditions hereafter provided.

Second: I give and bequeath unto my wife Catherine Walsh my household furniture; four sheep; and a quantity of hay now stored in Stable. It is my will that my daughters Elizabeth, Teresa, and Mary be given one sheep each at the time of their marriage, should their mother afford to do so.

Third: I also give and bequeath unto my son John Walsh that piece of land situated by Salmonier Road and bounded as follows - North by Salmonier Road, south by Garrett Walsh's land, East by James Walsh's land and West by James Walls land - provided that should my son Michael Walsh return to Holyrood to live permanently and desire to build a dwelling house, he Michael, is to have and to hold one half of said piece of land, situated on Salmonier Road.

Fourth: I also give and bequeath unto my wife Catherine Walsh until her death when it will become the property of my son Daniel Walsh under the conditions hereinafter provided - that piece of land situated between the Main Line and Railway Co's Land.

Fifth: It is also my will that if circumstances necessitate, my wife Catherine may sell any portion of the outside estate as a means to her support; and further should my son Daniel Walsh leave his mother permanently or neglect to contribute to her support, he (Daniel) shall forfeit all claims upon my estate.

Sixth: It is also my will that each of my children sons and daughters shall have a Mass offered for the repose of my soul.

And Lastly I nominate constitute, and appoint my said wife sole Executrix of this my will.

In witness whereof, I have hereunto set my hand and Seal, this Seventeenth day of September, one thousand eight hundred and ninety five.
