Crocker's Cove - Will of Martha Butt (1811)

Will of Martha Butt

I, Martha Butt of Crocker’s Cove, District of Conception Bay in the Island of Newfoundland, being infirm of body but of sound mind and memory, do this thirtieth day of November in the year of our Lord one thousand eight hundred and eleven (1811) make and publish this my last will and testament in the manner following, that is to say, First, I will and direct that all my just debts and funeral expenses shall be fully paid and discharged. Also, I do hereby give, devise, and bequeath unto my niece Jane Parsons, daughter of Robert Parsons of Harbour Grace, all that my Plantation situate at Crocker’s Cove aforesaid with the meadows, fishing rooms, dwelling house, outhouses and premises thereunto belonging for and during the term of her natural life, and in case the said Jane Parsons should die without heirs lawfully begotten then and in such case I do hereby give, devise and bequeath the same unto the sons and daughters of James Rowe of Hart’s Content, their heirs, executors, administrators and assigns, share and share alike. And in case my said niece Jane Parsons should happen to marry, my will is that the husband of her the said Jane Parsons shall have no claim and or part in the disposal of said Premises, but to be and remain as in before mentioned. Also, I do hereby give and bequeath unto my said niece Jane Parsons, all my household furniture with all my cattle, hay and implements of husbandry and all other my effects, lands, goods and chattels, and I do hereby nominate, constitute and appoint my said niece Jane Parsons whole and sole Executrix of this my last will and testament. And I do hereby nominate, constitute and appoint Thomas Baker and William Lampen both of Harbour Grace, Executors in Trust to see the due and true performance of this my said last will and testament hereby revoking and making void all former will or wills by me at any time heretofore made declaring these presents to be and contain this my true last will and testament. In testimony whereof I have hereunto set my hand and seal the day and year before written. Jonathon Marshall X the mark of Robert Clarke X the mark of Joseph Clarke This deponent Thomas Baker, the Executor within named maketh Oath and saith that Martha Butt the Testatrix has been dead for eleven years and upwards, that William Lampen the other Executor within named has been dead ten years and upwards, and that Jane Parsons (subsequently married to William Simms) departed this life at Harbor Grace on the seventh day of January, 1832, leaving one son and one daughter.
