Will of Levi Garland

In re     LEVI GARLAND.     DECEASED. In the name of God, Amen.

    This fifteenth day of August One thousand eight hundred & Ninety four.

    I, Levi Garland of Lower Island Cove in the Island of Newfoundland now residing at St. John’s in the Island aforesaid, of perfect mind and memory, thanks be unto God: but calling into mind the mortality of the body knowing that it is appointed unto all men once to die, do make and appoint this my last will and Testament, that is to say, principally, and first of all, I commend my body to the earth to be buried in decent Christian burial at the discretion of my Executors, and my soul into the hands of Almighty God who gave it, knowing that I shall receive the same again at the general resurrection by the Almighty power of God.

    And as touching such worldly goods wherewith it hath pleased God to bless me in this world, I do by these presents give and bequeath to my beloved wife Jane Penny Garland my dwelling house and effects within and without situate at 96 Barnes Road (North Side) in the City of St. John’s Newfoundland aforesaid. My wife Jane Penny Garland shall have no power to dispose of or transfer the above named dwelling house and effects to any person or persons during her lifetime.

    And provided my wife Jane Penny Garland should marry again she forfeits all claim to the above named dwelling house and effects. At the same time the above named dwelling house and effects or proceeds shall be divided equally amongst my four children, namely Samuel Elliott Garland, Alexander John Garland, Annie Maude Elizabeth Garland and Thomas Hall Garland.

    In case of any disagreement in my family at any time after my decease I empower my Executors Josiah Garland and Samuel E. Garland to hire or sell the above named property to the best advantage. The proceeds of such hire or sale to be given to my wife Jane Penny Garland, if unmarried and if married to be equally divided amongst my four children above named, my will to be opened six days after my burial and a copy of the same given to my beloved wife Jane Penny Garland.

    And I do by these presents utterly revoke and disannul all and every other Will and Testaments by me in any way made confirming this and none other to be my last Will and Testament.

    IN WITNESS WHEREOF I have hereunto set my hand and affixed my Seal this day and date aforesaid.
