Supreme Court of Newfoundland Harbor Grace to wit: I do swear that I believe John Britt late of Harbor Grace Planter my late Husband deceased, died without a Will; and that I will well and truly Administer all and every the Goods of the said deceased, and pay his Debts so far as his Goods will extend; and that I will exhibit a true, full and perfect Inventory of the said Goods of the deceased , and render a true account of my Administration into the Registry of the said Court, within Twelve months from the date hereof, or when I shall be thereunto lawfully required; and that the whole of the Goods, Rights, Chattels, Assets, Credits and Effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not according to the best of my knowledge, judgment and belief, amount to the value of Thirty Pounds Sterling. Supreme Court of Newfoundland Be it remembered that on this Twenty fifth day of May in the First year of the Reign of our Sovereign Lord William the Fourth by the Grace of God, of the United Kingdom of Great Britain and Ireland, King, Defender of the Faith, &c. and in the Year of our Lord One Thousand Eight Hundred and Thirty One personally appeared Margaret Lynch of Harbor Grace late Widow of John Britt, William Stirling of Harbor Grace Surgeon and Michael Dee of Harbor Grace Fisherman and did acknowledge themselves to be held and firmly bound to our Sovereign Lord the King his Heirs and Successors in the penal Sum of Sixty Pounds of good and lawful money of Great Britain, to be had, made and levied on their Goods, Chattels and Effects jointly and severally if Default is made in any of the Conditions following: Now the Condition of this Obligation is such, That if the above bounden Margaret Lynch Administratrix to the Estate of her late husband John Britt deceased, do make, or cause to be made, a just, true and perfect Inventory of all and singular, the Goods, Credits, and Effects of the said deceased, which have or shall come to the hands, possession, or knowledge of her the said Margaret Lynch or to the hands or possession of any other person or persons, for her and the same so made do exhibit, or cause to be exhibited, into the Supreme Court of Newfoundland, at or before the First day of May next ensuing the date hereof; and the said Goods, Chattels, Credits, and Effects, and all the other Goods, Chattels, Credits and Effects of the said deceased, at the time of his death, or which at any time afterwards shall come to the hands or possession of her the said Margaret Lynch or to the hands or possession of any other person or persons for her shall well and truly administer according to Law, and further shall make, or cause to be made, a just and true Account of her said Administration, on or before the First day of May which will be in the Year of our Lord One Thousand Eight Hundred and Thirty Two and afterwards from time to time as she shall be lawfully required. And all the rest, residue and remainder of the said Goods, Chattels, Credits and Effects, which shall be found remaining upon the said Administration Account, the same being first examined and allowed by the said Supreme Court of Newfoundland, shall and do pay and dispose of in a due course of Administration, or in such a manner as the said Court shall direct; -- then this Obligation to be void and of no effect, or else to be and remain in full force and virtue. Harbor Grace 14th May 1831 Sir:
I have the honor to transmit an application from Elizabeth Lynch late Widow of one John Britt for Administration to the Estate of her late Husband. This woman has often been before the Court here, and has now adopted the course recommended to her. I have the honor to be Sir Your very humble servant John Stark Clerk & Registrar Nor. Cir. Court Charles D Archibald Esq. Chief? Clerk? .. To the Honorable Judge Des Barres The Petition of Margaret Lynch of Hr. Grace Humbly Sheweth That about 10 years ago Petitioners late husband Jn Britt was unfortunately lost on a passage from the Labrador where he went on a Fishing voyage, and about 25 years ago the said Jn Britts only brother was also lost in Conception Bay. That the said Jn Britt duly and regularly administered for his said Brothers estate and effects which consisted of a certain property at Carbonear, a Dwelling House and Plantation and the same being out of Lease on the first of January of the present Year Petitioner on behalf of her children by said Jn Britt being seven made offer of sale of said property to a Mr. Wm. Dalton a resident of Carbonear, with whom Petitioner agreed to receive £30-0-0 currency, but which he very properly declined receiving or of paying that amount in consequence of the Estate or property not being properly regulated or settled in a legal way. That Petitioner will ever remember with thanks and gratitude Mr. Daltons kindness and charity in relieving herself and seven children when lately in distress, and as the only obstacle as to the payment of the above amount is a want of the necessary documents relative to this business, she therefore humbly implores your Lordship to assist her in whatever manner your Lordship may consider in your wisdom and goodness most fit. And Petitioner as in duty bound will every pray. That your Petitioner since the death of her said late Husband John Britt has intermarried with Patrick Lynch of Harbor Grace Planter. Your Petitioner therefore humbly prays that Administration to the Estate of her said late Husband may be granted to your Petitioner. Margaret Lynch (X, her mark)
