Will of John Morris

In re: JOHN MORRIS. DECEASED

This is the Last will and Testament of me John Morris (of William deceased) of Lower Island Cove in the District of Bay de Verde Newfoundland Made this 27th day of October 1907 A.D. Being of sound mind and with full power of my reasoning faculties yet anticipating sooner or later by the will of God that death is approaching and I shall die. I wish to dispose of my worldly possessions as follows + To my three sons John William & Stephen Morris I bequeath all my right title and claim to be equally divided among them if they are living on it or using the estate the Fishing Room Property what ever or where ever situated with the exception that Elias Wheeler or his heir my continue to use the Flake he now occupies and one fourth of the whole of my stage property with the understanding that they are never to sell it from the Estate and if they should not need the use of it and my heirs should want to use it they shall have the right to do so

I further bequeath to my eldest son John C. Morris the Lower Garden with all that appertains to it and the land on which Turners store now stands to be his personal property should he ever come to live on it or in the place except the land on which Turners store stands which is to be always in possession of the Turners as long as they pay Eight dollars annually for the rental of the same The said eight dollars to go to the support of my widowed wife Mabella Morris after her decease my son I or his heirs are to receive the said eight dollars land rent. I further bequeath to my son William Morris the two gardens across the Brook known as the Marsh Gardens as his own personal property should he come to the place to live or occupy them I further bequeath to my son Stephen Morris except that already mentioned in this my will all my goods & chattels houses and lands every where and whatever except the inside Farm which is to be equally divided between my three sons already mentioned to be his own property solely after the death of his mother or in the event of her marriage to another man during her single life she is to get her living from the Estate.

I further in this my last will and Testament protest against either of my sons or heirs selling outside the family any portion or portions of the Estate mentioned in this will but which ever one or two live on the property they are to receive the benefit therefrom. Further I request that should my son John wish to change land with William H. Morris now enclosed in the lower garden land from the Marsh Gardens willed to William is to be given in its stead and William is to be rewarded land from that Garden known as Wheelers Garden even to the half of it I appoint A.G. Hudson J.P. and Eli Garland as Executors to this my Last will and Testament John Morris (LS) Signed in our presence who in his presence and in the presence of each other and at the same time subscribe our names as witnesses Eli Garland Henry his x mark Louis & witness A.G. Hudson.
