In re James Delaney deceased. In the name of God. I James Delaney of Bay Roberts, Planter, being very sick and weak in health but of perfect mind and memory knowing that is appointed for all men once to die do make and ordain this my last testament, that is to say principally and first of all I give and recommand my soul to the hand of Almighty God that gave it and my body I commend to the earth and as touching my wordly estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following mamer and form, First I give and bequeath the one half of the schooner Eclipse and all craft belonging to her and also the one half the fishing room and boats now lying in Ship Harbour, Labrador, for the support of my remaining family The Company account is to follow as before under the title of James and Richard Delany If one or more of my children changes their way of life that is to take a wife he has no more share in the schooner except that he remains in the Company. That part of my land now lying between John and William Delaney's plantation I bequeath to my eldest son Martin Delaney to my oldest daughter Mary Badcock I give to her that part of my land lying between Matthew Delany bounds and the lane leading from the main road to my dwelling house. My plantation lying on the south side of this harbour bounded by John Kelly and William Chard to each of my five sons I bequeath the one fifth part of the plantation. The plantation I now inhabit is to be equally divided in four shares at the sea side and also on the back land that is to my four children James, Richard, John and Edward Delany leaving the eastward part of my plantation to my son Edward and is not to obtain the same untill after the death of his mother Mary Delany, the dwelling house,stable and cellar included with the estward part of my plantation to my two daughters Elizabeth and Ellen Ryan I bequeath to each of them 20 pounds currency. To my youngest daughter Jane Delany I bequeath to her 30 pounds currency. The cattle to remain with my loving wife and I do hereby utterly disallow revoke and disanul all and every otherformer testaments wills legacies bequests and executors by me in any wise before named willed and bequethed ratifying and confirming this and no other to be my last will and testament In witness whereof I have set my hand and seal this 10th day of December in the year of our Lord one thousand eight hundred and forty six 1846.
