I, Henry Sheppard, of Spaniard’s Bay in the Island of Newfoundland, being in perfect health of Body and of perfect mind and memory and knowing it is appointed for all Men once to die, do make and ordain this my last Will and Testament, that is to say principally and first of all, I give and recommend my Soul unto the hand of Almighty God who gave it, and my body I comment to the Earth to be buried in decent Christian burial at the discretion of my Executors, nothing doubting but at the general resurrection I shall receive the same again by the Almighty power of God, and as touching such worldly Estate wherewith it hath pleased God to bless me in this life, I give devise and dispose of the same in the following manner and form – First, I give and bequeath unto my beloved Son, Henry Sheppard, whom I constitute, make and ordain the sole Executor of this my last Will and Testament, all and singular my lands messuages and tenements that I now hold in my possession, also an uncleared piece of land which lies to the South of the bounds of my Plantation. I also give and bequeath unto the said Henry Sheppard one half of my Boat and Craft and half my Fishing Room by him to be freely enjoyed and possessed. I also give and bequeath unto my beloved Son, John Sheppard, that piece of land that he now holds which lies to the North of his House. I also give and bequeath unto my dearly beloved Wife the sum of Fifty pounds Newfoundland currency to be raised and levied out of my Estate by the said John and Henry Sheppard. I do hereby disallow, revoke, and disannull all and every other former testaments, wills, legacies, bequests and executors by me in anywise before named willed or bequeathed, ratifying and confirming this and no other to be my last Will and Testament. In Witness whereof I have hereunto set my hand and Seal this 23rd day of August in the year of our Lord on thousand eight hundred and thirty Two- Signed, sealed and delivered and declared by the said Henry Sheppard as his last Will and Testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names-
I also give unto my beloved son John Sheppard One half of my Boat & Craft also one half of my Fishing Room. I do hereby make and ordain this as part of my last Will and Testament. I do hereby Certify that the execution by the Testator, Henry Sheppard, of the Will of which the foregoing is a true and correct Copy, was proved before myself on the Thirtieth day of March in the year A.D. one thousand eight hundred and forty six by the Affidavit of Edward Dwyer, one of the subscribing Witnesses thereto, and the same is hereby actually Registered by me this day. Given under my hand this Second day of April one thousand eight hundred and forty Six A.D. 1846. |
