Francis Sheppard deceased.

This is the last will and testament of me Francis Sheppard of Harbor Grace in the Island of Newfoundland, Planter, I give devise and bequeath unto my daughter Ann Way wife of John Way the western part of my house which I now occupy comprising my bedroom and the room underneath the same to hold to the said Ann Way during the term of her natural life free and independent of her said husband or any debts or liabilities he may have and after the death of the said Ann Way I give devise and bequeath the same to the said John Way during the term of his natural life in case he should survive the said Ann Way and after the decease of the said Ann Way and John Way I give devise and bequeath the said western part of my house to my son John Sheppard his heirs and assigns for ever.

Secondly I give devise and bequeath the remaining portion or part of my said house unto the said John Sheppard to have and to hold the same to the said John Sheppard his heirs and assigns for ever.

Thirdly, I give devise and bequeath all my land and the erections thereon not hereinbefore mentioned to the said Ann way and John Sheppard share and share alike the same to be divided equally between them by my executors hereinafter named and such other persons as my said executors or the said Ann Way and John Sheppard shall direct and appoint for such purpose, the said Ann Way to have and to hold her part or portion of the said land and premises during the term of her natural life free and independent of her said husband but should the said Ann Way die before the said John way then the said John Way shall have and hold her part or portion of the said land and premises during the term of his natural life and as to the part or portion of the said land and premises hereinbefore bequeathed to the said John Sheppard my will and desire is that he old the same to himself his heirs and assigns for ever and after the decease of the said Ann Way and John Way I give devise and bequeath their part or portion of the said land and premises to the said John Sheppard his heirs and assigns for ever.

Fourthly, I give devise and bequeath all the wearing apparel belonging to my late wife Patience to the said Ann Way, my sealing gun to William Noseworthy and a feather bed to George Usher.

Fifthly, I give devise and bequeath all my goods and chattels and other property not hereinbefore mentioned to the said Ann Way and John Sheppard to be divided between them share & share alike by my said executors or such other person or persons as they may appoint after the payment of my just debts and funeral expenses.

Lastly, I hereby appoint Henry Taylor Lemon, John Gillard, Senior, and Robert Mayne, all residing on the south side of Harbor Grace, executors to this my last will and testament, hereby revoking all other wills by me before made.

In witness whereof I have hereunto set my hand and seal at Harbor Grace aforesaid this thirteenth day of April in the year of our Lord one thousand eight hundred and fifty two.
