Will of Amelia Davis |
In re Amelia Davis deceased. This is the last will & testament of me Amelia Davis of Carbonear in the Island of Newfoundland, I give devise and bequeath all my property which shall consist of lands houses or other buildings of which I shall be possessed or entitled to at the time of my decease or over which I have a disposing power whether the same consists wholly or in part of estates of freehold or of any nature or kind whatsoever unto my friends John Bemister of Carbonear aforesaid Merchant and Robert Henry Prowse of St. John’s in the Island of Newfoundland aforesaid Gentleman and the survivor of them and the heirs executors administrators and assigns of such survivor do and shall stand and be seized and possessed thereof to for and upon several trusts hereinafter mentioned and declared of and concerning the same, that is to say, upon trust to reimburse and indemnify themselves for all expenses to which they may be put in carrying into effect this my will and the annual expenses incident to the insurance improvement and keeping in repair of any of the said premises respectively and after payment of such expense in trust to pay unto the children of my late brother George Davis deceased who may survive me their heirs and assigns share and share alike namely to William George, Edward, Frederick, Mary, Leonore and Jane or the survivor or survivors of them the net rents year by year as they become due of that part of my said estate situate on the north side of New Gower Street in the said town of St. John’s now let to Martin Deady and also the meadow and premises formerly let to Kavanagh and Ivaney and since let to Peter Rogerson and unto Frederick William son of the late Joseph Samuel Tewlon formerly residing at Carbonear aforesaid the net rents year by year as they may become due of that part of my said estate situate on the north side of New Gower Street aforesaid let to Peter Rogerson and Edward Dunphy in trust that the said John Bemister and Robert Henry Prowse do and shall convey and assign as soon as conveniently may be after my decease unto the said Edward and Frederick sons of my late brother George Davis or the survivor or survivors of them their heirs and assigns all my land and premises situated at the south side of Carbonear aforesaid. In witness whereof I hereunto set my hand & seal at Carbonear aforesaid this twenty second day of November one thousand eight hundred & forty nine.
