Will of Samuel Mercer
In the name of God Amen the fourth day of February 1852, I, Samuel Mercer, of Bay Roberts, Planter, being very sick and weak of body but of perfect mind and memory thanks to God, therefore, calling unto mind the mortality of my body and knowing that it is appointed unto all men once to die do make and order this my last Will and Testament, that is to say specifically and first of all I give and commend my soul into the hands of the Almighty God who gave it and my body I recommend to the earth to be buried in a decent Christian burial at the discretion of my executors and as touching such worldly estate where it had pleased God to bless me in this life. I give and demise and dispose of the same in the following manner and form – first, I give and bequeath to Jane, my dearly beloved wife, the dwelling house store, stables, cellars and outhouses with all my goods and chattels I now possess, during her natural life and after her decease, to my youngest son, Abraham, I give and bequeath my dwelling house, store, stables, cellars and outhouses with the fourth part of all the back lands and the seventh part of the eastern side premises to the south of the street also to my other six sons, I give a seventh part of the said water side. I also give and bequeath to my grandson, Thomas, the garden to the east of my premises called the Forge Garden with the fourth part of all my back lands called the Hill Garden and _________. I also bequeath to Stafford and Charles and Abraham, the garden with the rest of my dwelling and the _________and garden to the south to be equally divided, with the exception of thirty feet square which I bequeath to my son, William in front of the place he is about to erect his house and that no dispute hereafter should take place. I hereby appoint my eldest son, Isaac Mercer, to assist my beloved wife, my sole executrix. I hereby deem it prudent to give the whole of the West Garden to Stafford and Charles -------------Isaac Mercer, Thomas Calpin, Charles Calpin-------------------- I hereby certify that the executor of the Will of which the foregoing is a true and correct copy by Samuel Mercer the Testator party thereto was proved before myself on the tenth day of December one thousand eight hundred and fifty three by the affidavit endorsed herein of Charles Calpin, one of the subscribing witnesses thereto and the same is in due course hereby actually registered by me this day.
