| In re Michael J. Mahoney. deceased This is the last Will and Testament of me Michael Mahoney of Burin North, in the Electoral District of Burin in the Island of Newfoundland. Tinsmith, and Dealer in Stoves and metalware, hereby revoking all wills, testaments or codicils by me at any time heretofore made. I devise and bequeath all my estate, real and personal, to my Executors and Trustees hereinafter named in trust for the purposes following:- Firstly, to pay my just debts, funeral and testamentary expenses, and thereafter in trust to dispose of and pay over or convey the same to the person or persons or corporations hereinafter named as follows:- [A] to my daughter Margaret Mahoney all my cash deposits in the Bank of Montreal, branch at St. John's N.F. also all my cash deposits in the Bank of Nova Scotia branch at Burin N.F. also all my cash deposits in the Canadian Bank of Commerce, branch at Burin N.F. [B] The stock in trade [in the store occupied by me jointly with Patrick Quinan, which business is carried on under the name of Mahoney and Quinan, situated at Burin] is to be valued, also the tools and implements employed in the said business to be valued also, and half of the value of the whole, together with twenty-five percent of the residue to be allotted to my partner Patrick Quinan, the other part is to be turned into cash, and becomes the property of my daughter Margaret. [C] The above named Patrick Quinan, may have the use of the store, at present occupied by us conjointly, by paying my daughter Margaret a yearly sum of one hundred dollars as rental, whilst he remains in business, and in the event of his leaving, the store itself comes into possession of my daughter Margaret, to be her sole property. [D] The ground rent of the store at present in the occupancy of Messrs Goldstone, dealers in Dry Goods etc., is $225.00 per annum, and after my decease, the rent herein named is to be divided between my three daughters Mary, Elizabeth and Margaret, each taking an equal share. [E] The rent received by my daughter Margaret, for the house I at present occupy, is to be likewise divided between my three daughters above named. The rental of the annex of said house, at present in the occupancy of the Canadian Bank of Commerce, is also to be divided by Margaret, between herself, and Elizabeth and Mary. [F] The rental received from the hire of the meadowland, adjoining, and situate at the North of the house I at present occupy, also the hire of the piece of land, with a stable at present erected thereon, and occupied as a motor car garage by Vincent Reddy, Esq. merchant of Burin aforesaid, is to be divided equally by my three daughters as mentioned above. [G] The furniture in the house I now occupy, together with all and sundry, furniture, pictures, cooking utensils etc. beds and bedding becomes the property of the above mentioned Margaret Mahoney, but it she disposes of it, she must give equal shares between herself and her sisters above mentioned, Elizabeth and Mary. I nominate, constitute and appoint Rev. Thos J. Bride, Parish Priest trustee of this my last will, with full power and authority to sell and dispose of all my estate where necessary, and execute any and all documents requisite to carry out this my will, and should one or more of my said Executors or Trustees wish to retire I authorize them to appoint a successor instead thereof.
