Will of James O'Neill 1910

THIS IS THE LAST WILL AND TESTAMENT of me, James O’Neill, of St. John’s in the Island of Newfoundland, Shoemaker. I revoke all former wills by me at any time made, and I appoint my brother Francis O’Neill, at present of Roxbury in the state of Massachusetts in the United States of America, to be the Executor of this my will. I give and bequeath to my said brother Francis O’Neill and my brother Charles O’Neill, of St. John’s aforesaid, all my property of every kind soever of which I may die possessed, including in particular my share or interest in dwelling-house and premises on New Gower Street in St. John’s aforesaid and in a piece or parcel of land on the Thorburn Turnpike Road, and also the insurance on my life under the policy which I hold in the Manufacturers’ Life Insurance Company: TO HOLD the same unto my said brothers Francis and Charles in equal shares for their separate use. IN WITNESS WHEREOF I have hereunto subscribed my hand at St. John’s aforesaid this twenty-sixth day of April in the year of Our Lord One thousand Nine hundred and Ten. O’Neil, of St. John’s in the Island of Newfoundland, Baker, by his Solicitors Conroy & Higgins. HUMBLY SHEWETH that: James O’Neil, late of St. John’s aforesaid, Shoemaker, brother of Your Petitioner, deceased, died at the said place on the 17th day of January, 1914, having previously made his last will and testament whereby he appointed Your Petitioner the Executor thereof. The said deceased left him surviving as next-of-kin at the time of his death four brothers, namely: William, John, Charles, and Your Petitioner. The paper-writing hereunto annexed marked “A” is the said last will and testament of the said deceased proved upon the affidavit of William J. Higgins, one of the subscribing witnesses thereto. The paper-writing hereunto annexed marked “B” is a correct and true inventory and valuation of the estate and effects of the said deceased at the time of his death so far as Your petitioner can at present ascertain. Neither Probate to any will nor Letters of Administration to the estate of the said deceased have been granted forth of this Honourable Court to anyone. Your Petitioner, therefore, prays that this Honourable Court or Your Lordship may be pleased to grant to him Probate to the said last will and testament of the said deceased.
