In re WILLIAM STARES. DECEASED. Know all men by these presents that I William Stares the elder being weak in body but sound in mind and intellect do make and ordain this my last Will and Testament. First I bequeath my body to the ground to be interred in Christian burial. Second I bequeath to my daughters Mary Brace and Susanna Wiseman and to my granddaughter Emeline Snowball Knight one fourth portion each of that part of Cherry Garden lying to the eastward of the Brook east of my present dwelling house and the remaining one fourth portio n to be for my Son William Stares the western boundary of the said portion so given and bequeath as above to my children William Mary and Susanna and my granddaughter Emeline to be the aforesaid brook and a line running in a straight line therefrom to the River.Second, I give and bequeath to my son Meshack Stares and to my two daughters Sarah Lyon and Charlotte Rhodes one half acre each at the West end of this my estate of Cherry Garden and be it known unto all men that I hereby give and bequeath the aforementioned property to my daughters and granddaughter in their own right. And last all the remaining portion of my personal and real estate I give and bequeath to my son William Stares. To the Honourable Francis Brady Chief Justice and the Honourable The Associate Justice of the Supreme Court of Newfoundland The Petition of William Stares of St. Johns Farmer Here by serveth: That on the twenty-fifth day of September last your Petitioner's Father William Stares Farmer died at St. Johns having made and published his last will and Testament described in the office of the Chief Clerk of the Court. That as Executor is appointed to the said will. That your Petitioner is the eldest son of deceased to whom he has bequeathed the greater part of his property and appointed him perciduary (?) legate. That the Estate and effects of the said deceased are of the probate value of Four hundred pounds Currency. That I the said will at the obedience of deceased act herein mentioned as legate. (?)
