The Will of William Roberts of Ferryland - 1674

In the Name of God Amen. The ffirst day of ffebruary in the Seaven and Twentyth yeare of the Raigne of our Soveraigne Lord Charles the Second by the grace of God of England Scotland ffrance and Ireland King Defender of the faith ?. And in the yeare of our Lord God according to the Computation of the Church of England 1674. I WILLIAM ROBERTS of FFERRYLAND in the Newfound Land fisherman being of good health in body and of a sound and perfect memory Thanks be given unto God for the same considering the frailty of mans nature the certainty of Death and the uncertainty of the time doe therefore make this my last Will and Testament in manner and form following hereby revoking all former and other wills by me made. Imprimus I surrender my Soule into the hands of God that gave it and I commit and commend my body to the Earth from where it was taken. Item I give and bequeath unto the poore people of KINGSBRIDGE in the county of DEVON the summe of ffyve shillings the lawful money of England to be distributed to them by the overseers of the Poore. Item I give and bequeath to EBBETT my well beloved WIFE all that my Cottage or Messuage and Tenement situate lying and being in KINGSBRIDGE aforesaid between the lands there of (unknown symbol inserted) Sand? Ffortesix? Baronett on the South and the Lands of ROGER MILLS on the North to have and to hold the said Cottage Messuage and Tenement with the appurtenances to my said wife and her assignes for and during her naturall life. Item I give the immediate ?eeverrow of the said messuage and tenement after the death of my said wife and all the Estate right title and interest of me the said William Roberts of and in the foresaid messuage and Tenement unto WILLIAM ROBERTS my ELDEST SONN and his heires males, forever To have and to hold the said Cottage Messuage and Tenement with the appurtenances after the death of his foresaid mother to the said William Roberts my sonn and his heires males forevermore. And my will is that if my said sonn William Roberts dye without issue heire male as aforesaid That my SECOND SONN THOMAS and his heires males shall have hold and enjoy the same Messuage and Tenement with the appurtenances to him and his heires males forever. And in defalt of such issue I give and bequeath the said Messuage and Tenement with appurtenances to my THIRD SONN JOHN and his heires males forever. And in defalt of such issue I give and bequeath the same Messuage and Tenement with the appurtenances to my FFOWIRTH SONN DAVID and his heires males forever. And in defalt of such issue to my FFYTH SONN NICHOLAS and his heires males forever. And in defalt of such issue to my SIXTH SONN CHRISTOPHER and his heires males forever. And in defalt of such issue To the right heires of mee the said William Roberts forever more. Item I give unto my foresaid wife three ? Poundes of lawfull money of England. Item I give to my Sonn WILLIAM fforty Poundes. Item I give to every of my other sonnes aforenamed Twenty Poundes a peece all which severall summes of Three ? Pounds fforty Pounds and Twenty Pounds a peece shall be paid to each person aforesaid out of the money due to mee on Two Bonds which I have left in the custody of JOHN YEABB of KINGSBRIDGE aforesaid YEOMAN when the same money shall become due to be paid or ?onered by law to be paid on or by the foresaid bonds. Item I give and bequeath unto my ? sonnes abovenamed two parts of all my other goods and Chattells in FFERRYLAND aforesaid or any other part of the world in three parts to be devided equally to be devided amongst my foresaid Children. Item my Will and mind is that if any of the sonnes aforesaid happen to dye before he or they so dying shall accomplish the age of Eighteene yeares Then his and theire Legacyes so hereby given him and them shall be equally paid and distributed to and amongst the survivor and survivors of them. Item the other third part of all my aforementioned Goods and Chattells not before hereby given nor bequeathed I give and bequeath unto my foresaid well beloved WIFE whome I doe make constitute and ordeine to be my sole Executrix of this my last Will and Testament. And I desire JOHN YEABB aforesaid JOHN TRIPE the ELDER of KINGSBRIDGE aforesaid Merchant DAVID KIRK of FFERRYLAND aforesaid Gentleman and Mr CHRISTOPHER POLLARD of CAPLING BAY in NEWFOUNDLAND aforesaid my trusty and well beloved friends either joyntly or severally to be overseers of this my last Will and to see my said Executrixe faithfully to performe the same if they please. PROBATUM follows in Latin. which appears to use the word November (Novembris) and the year possibly 1677 (Anno Dm Millefino Sexcentesimo Septuagesimo Septimo) and mentions his wife Ebbett Roberts, Relicte and Executrixe.
