In re: WILLIAM POWER. DECEASED.
This is the last will and testament of me William Power of Outer Cove in the Electoral District of St. John’s East in the Island of Newfoundland Farmer. I revoke all former wills by me at any time made and I appoint the Reverend Michael J. Clarke of Torbay the executor of this my will.
First I give and bequeath to my daughter Johanna Brien the sum of two hundred dollars. To my daughter Mary Power(?) the sum of two hundred dollars and to my daughter Elvira Power the sum of two hundred and thirty dollars.
Secondly I give and bequeath to my said executor the sum of twenty dollars for his own use, to the community of Torbay Convent the sum of Twenty dollars, to my said executor the sum of forty dollars for masses for the repose of my soul, and the sum of forty dollars for a headstone for my grave and I direct that the names of my mother, myself and my wife be placed on said headstone.
Thirdly I direct my said executor after payment thereout of my debts and testamentary and funeral expenses to pay the residue of my ready money to my son Walter Power.
Fourthly I bequeath to my said executor my land on Pennywell Road, St. John’s, upon trust in the first place to permit my son Patrick to use the same and enjoy thereunto issues and profits thereof during his stay in Newfoundland, if he shall return to Newfoundland within three years from the date of my death but if otherwise, or if my said son Patrick shall quit Newfoundland after his return, then upon trust to assign the same to my daughter Johanna Brien absolutely.
Fifthly I bequeath to my said executor upon the same trusts as those hereinbefore fourthly contained my land known as Slaters? Place saving and reserving thereout the south eastern portion thereof now used by my son Walter for grazing.
Sixthly I bequeath to my sons Walter and Patrick my wooded land at Cobblers Hole to hold the same in equal shares as tenants in common, but upon the following conditions namely (1) unto my son Patrick that he returns to Newfoundland within three years from the date of my death and (2) as to both my sons that neither will give away any of the timber on the said land or permit any other person to cut timber thereon (or any kind of wood) without the consent of the other.
Seventhly, all the rest residue and remainder of my property including lands, house, barns, cattle, furniture, carts and so forth, I give and bequeath to my son Walter absolutely.
In witness whereof I have hereunto my hand subscribed at Outer Cove aforesaid this thirty first day of July AD 1905

Signed published and declared by the said testator as and for his last will and testament in presence of us who in his presence and in presence of each other at his request hereto subscribe ourselves as witnesses attesting the due execution thereof the same having been first read over to and approved by the testator in our presence and signed by him by making his mark thereto
