In re William Hogan deceased. In the name of God Amen. I William Hogan of St. John’s in the island of Newfoundland Saddler do make publish and declare this to be my last will and testament First- I will and direct that all my debts and funeral and testamentary expenses shall be paid by my executors hereinafter named as speedily as possible after my decease. Second I give devise and bequeath to my executors hereinafter named the five shares in the Union Bank of Newfoundland of which I am possessed upon trust to pay the annual dividends which shall accrue thereon to my wife Ellen Hogan during her lifetime for her sole use behoof and benefit and I do direct that should the said shares be at any time during the continuance of the said trust increased by any allotment of shares or otherwise then such increased shares shall be taken and held by my said executors subject to the trusts herein declared of and concerning the shares I now hold and the annual dividends on such increased shares shall also be by them paid to my said wife Ellen Hogan during her lifetime for her sole use behoof and benefit. and upon the further trust on the decease of my said wife then to assign and convey the said shares and any increased shares as above mentioned, to my daughter Mary Joseph Hogan for her sole and separate use free and independent of the debts liabilities and control of any husband she may have. Thirdly. I give devise and bequeath all and singular the rest residue and remainder of my lands goods property chattels credits and effects of whatsoever nature or kind the same may be or wheresoever situated to my daughter Mary Joseph Hogan as separate estate to be by her held and taken free and independent of the debts liabilities and control of any husband she may have. Fourthly I do hereby nominate constitute and appoint my friends William P. Walsh of Water Street St. John’s Merchant and Robert J. Kent of same place Barrister at law executors of this my last will and testament and lastly I do hereby revoke annul and declare void all former and other wills by me heretofore made. Witness my hand at St. John’s aforesaid this eleventh day of October Anno Domini 1876. William Hogan. Signed published and declared by the said William Hogan as and for her last will and testament in our presence who at his request in his presence and in the presence of each other have hereto subscribed our names as witnesses on the day and year and at the place above written. Robert J. Kent, James M. Donnelly. I William Hogan of St. John’s Saddler in the above written will named do make and publish the following as and for a codicil to my said will. I will and bequeath the house in which I now live and all its furniture and contents to my beloved wife Ellen Hogan for her sole use and benefit. I also will and bequeath to her all such cash balances as may at time of my decease be standing at my credit in any Bank. Also all and singular such debts as shall be then due to me by any persons whomsoever I also give and bequeath to my said wife all the rents issues and profits of that house in Water Street now occupied by Denis Dooley to be paid to her until she shall have received therefrom a sum equal to the amount by me in the course of this present year expended in repairs and alterations in and about the said house and such further sum as may be required to complete said repairs and alterations the sum required to complete said repairs to be provided from and out of my estate. The income of the house occupied by Manwarring I give and bequeath to my said wife for her lifetime and after her decease the said house shall become and be the property of my said daughter Mary Joseph as separate estate free and clear of the debts liabilities and control of her husband. I direct that my said executors shall and will out of my estate pay to my daughter Ellen now a nun in Montreal a sum of one hundred dollars per year for four years if she shall live so long but should she die before the expiration of that time such payment shall cease. I give and bequeath the sum of five pounds to the Benevolent Irish Society to be expended towards the erection of St. Patricks Hall. I give and bequeath the sum of ten pounds to the Superior for the time being of the Christian Brothers to be expended towards the erection of the new residence for the said Brothers Witness my hand at St. John’s this thirteenth day of September Anno Domini 1878.
