The Petition of Patrick Martin of St. John’s
Yeoman
Humbly Sheweth

That your petitioners father the late Thomas Martin of St. Johns farmer died at that place on or about the twentieth day of March A.D. 1866 intestate and leaving him surviving seven children namely John now aged about thirty years and resident at Catalina in the said island Thomas aged about twenty eight years now resident in the United States and married Patrick your petitioner and aged about twenty five years James aged about twenty years William aged about fourteen years Timothy aged about nine years Robert aged about five years and Ellen now married and resident in Boston in the United States. That said intestate died possessed of property situate within the jurisdiction of this Honorable Court of the probable value of about Eighty Dollars consisting principally of a small piece of land containing about one acre and situate on the Portugal Cove Road in the neighbourhood of St. Johns aforesaid. That petitioner has agreed with one William Nugent for the sale to him of the said piece of land. That petitioners said brothers and sister are each and all aware of the said sale to Nugent and approve of the same That the proceeds of such sale are to be applied for the maintenance and support of said Robert which applications of such proceeds is also known to and approved of by the said brothers and sister That in order to complete the said sale and give A little to the said Nugent it is necessary that some One should be appointed administrator to the Estate of the said deceased Thomas Martin. Petitioner therefore prays that such administration May be granted unto him and as in duty Bound he will ever pray.

TO WIT                                 I Patrick Martin

do swear that I believe Thomas Martin late of St. John’s aforesaid Farmer deceased, died without a Will ; and that I will well and and truly administer all and every the Goods of the said deceased, and pay his Debts, so far as his Goods will extend ; and that I will exhibit a true, full and perfect Inventory of the said Goods of the Deceased, and render a true account of my Administration into the Regis- try of the said Court, within six months from the date hereof, or when I shall be thereunto lawfully required ; and that the whole of the goods, rights, chattels, assets, credits and effects of the said deceased, which he died possessed of, within the jurisdiction of this Court, do not, according to the best of my Knowledge, judgment and belief, amount to the value of One Hundred Dollars.
