Transcriber’s Note: While this will was indexed under
Thomas ‘GRUTHY’, it is my feeling that the last name may have been ‘GRUCHY’. The
handwriting is such that the small letter “c” runs into the next letter “h”,
making it look like a “t”. For instance, the word “each” looks like “eath”.
Therefore the name assumed to be “Gruthy” I feel is very likely “Gruchy”. Note
there is a family name “De Gruchy” from the Jersey Isles with an early presence
in Newfoundland. The Will of Thomas Gruthy/(Gruchy?) of St. John’s - 1712 From the Prerogative Court of Canterbury In the Name of God Amen. Know all men by these presents that I THOMAS GRUTHY, inhabitant of Saint Johns in Newfoundland of present in EXON this seventh day of March Anno Domini One Thousand Seven Hundred and Twelve and in good and perfect health and memory thanks be to God and calling to remembrance the uncertain estate of this Transitory Life and that all fflesh must yield unto Death when it shall please God to call do make and declare this to be my Last Will and Testament in form and manner following and do hereby revoke disannull and make void all my former Wills ffirst being penitent and sorry for all my sins most humbly desiring of God pardon for the same I commend my Soul unto Almighty God my Saviour and Redeemer insofar and by whose merits I trust and believe assuredly to be saved and to have full remission and forgiveness of all my Sins and inherit the Kingdom of Heaven and my Body I commit to the Earth to be decently buried wherever I shall dye at the discretion of my Executors in Trust hereafter named and for those things of my Temporal Estate and such goods chattels and debts as if hath or shall please God to bestow upon me I do order give and bequeath the same in manner and form following. Imprimus I order that what I may remain indebted at my decease and the charges of my burial may be discharged and of the remainder of my goods Chattles and Effects wherever I give and bequeath unto my loving son THOMAS GRUTHY the ffourth part of my PLANTATION in NEWFOUNDLAND and all other goods and debts standing or belonging unto me. Item I give and bequeath unto my son WILLIAM GRUTHY one ffourth part of my aforesaid Plantation goods debts. Item I give and bequeath unto my DAUGHTER ELIZABETH GRUTHY now wife of JOHN JERARD of Newfoundland one ffourth part of my aforesaid Plantation goods and debts. Item I give and bequeath unto my DAUGHTER SARAH GRUTHY one ffourth part of my aforesaid Plantation Goods and Debts and further I order that in case any of my aforesaid children should come to dye before they are of age that my surviving children shall have equall share in the deceaseds portion and do hereby make constitute and appoint my loving FFREINDS MR. JOHN PYN, Merchant of EXON and CAPn HENRY PEARDEN of EXMOUTH my Executors in Trust of this my last Will and Testament desiring and requesting them to see the premifses only(?) performed.
